As you will recall, the property <br />owner contends that an accessory structure on his property was built prior <br />to zoning changes which would subject it to Conditional Use Permit <br />requirements. In support of that contention, the owner provided Staff with <br />the aforementioned canceled checks. Although most of the contacts <br />acknowledged that purchases were made for materials, they were unable to <br />give specifics as to what those materials were used for. <br />In addition to following up on the canceled checks, Council directed Staff <br />to have the City Attorney contact the legal representative of the property <br />owner requesting written affidavits from construction workers or neighbors <br />who can verify that the structure was erected prior to the zoning change. <br />The City Attorney has informed Staff that, following some minor delays, he <br />has been in contact with the property owners attorney and the affidavits <br />are forthcoming.
