Mounds View City Council January 22, 2007 <br />Regular Meeting Page 7 <br /> <br /> 1 <br />Council Member Flaherty asked if a sale was wrung up for that person at the counter. 2 <br /> 3 <br />Mr. Xiong said he cannot recall for certain because that was a year and a half ago. 4 <br /> 5 <br />Council Member Flaherty asked if there was a sale to a minor on that date. 6 <br /> 7 <br />Chief Sommer indicated that Mr. Xiong was charged with it in January and it occurred in 8 <br />October and he was convicted. 9 <br /> 10 <br />Mr. Xiong indicated that the case is not fully completed as it goes to court in February. 11 <br /> 12 <br />Council Member Flaherty asked whether a sale was made to a minor. 13 <br /> 14 <br />Mr. Xiong asked if a full sale is considered the individual leaving the store or if simply handing 15 <br />over money is considered a full transaction. 16 <br /> 17 <br />City Attorney Riggs asked whether there was a business transaction that occurred. 18 <br /> 19 <br />Mr. Xiong said that the person gave him money but he had no bottle when he left the store and 20 <br />the money was for something else because he had stolen from his store previously. 21 <br /> 22 <br />City Attorney Riggs asked if Mr. Xiong is claiming that no transaction occurred. 23 <br /> 24 <br />Mr. Xiong indicated that the person had stolen from him for two days straight. 25 <br /> 26 <br />Mayor Marty said that the individual said that he had come in previous times with a fake 27 <br />identification and had not been carded and had not used it for a number of months and was still 28 <br />allowed to purchase alcohol. He then said that when the license holder was in last year for 29 <br />licensing Council cautioned that a suspension was possible for another offense. He further said 30 <br />that two things happened one with alcohol, and one with tobacco and both compliance checks 31 <br />were failed. He also said that waiting for the court date is totally separate on the criminal case 32 <br />and this is the license renewal that the City can control. 33 <br /> 34 <br />MOTION/SECOND: Marty/Flaherty. To Waive the Reading and Approve Resolution 7003, 35 <br />Civil Penalty and Suspension of Liquor License for ABC Liquor. 36 <br /> 37 <br />Council Member Stigney mentioned that this Resolution approves a civil penalty of $2,000 and a 38 <br />suspension of the license for 30 days. 39 <br /> 40 <br />Mr. Ge Xiong asked whether the penalty would be for each offense. 41 <br /> 42 <br />Mayor Marty indicated that this is the total for the offenses. 43 <br /> 44 <br />Mr. Ge Xiong indicated he would be willing to attend classes to help him make sure that 45 <br />underage persons do not buy at his store. 46 <br /> 47
