RESOLUTION 7018 <br /> <br />CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />APPROVING THE SUFFICIENCY OF PETITION IN OPPOSITION TO THE 20007-08 <br /> STREET IMPROVEMENT PROJECT <br /> <br /> <br />WHEREAS, Section 8 of the Mounds View City Charter provides that the City Council <br />has held a public hearing in regard to the proposed 2007-08 Street Improvement Project; <br />and, <br /> <br />WHEREAS, at such hearing the City Council received written and oral statements, <br />and heard petitioners for or against the proposed improvement; and, <br /> <br />WHEREAS, a period of sixty days was commenced after the public hearing and <br />before any further action shall be taken by the Council on the proposed improvement; and, <br /> <br />WHEREAS, within such sixty day period, a petition against such improvement was <br />filed with the Council, signed by a majority of the owners proposed to be assessed for the <br />improvement; and, <br /> <br />WHEREAS, said petition in opposition to the project has been examined and <br />determined sufficient by the City Clerk/Administrator, being that the project area contains <br />a total of 328 units that were to be included in the project and assessed for the <br />improvements, and 167 verified properties have expressed opposition to the project via <br />the petition now. <br /> <br />NOW, THEREFORE BE IT RESOLVED, that the Council of the City of Mounds <br />View hereby finds the petition in opposition to the 2007-08 Street Improvement project <br />to be sufficient; and, <br /> <br />BE IT FURTHER RESOLVED, the Council shall not make such improvement at the <br />expense of the property benefited, and shall not take a vote on the same improvement <br />within a period of one year after the public hearing on said improvement unless, as <br />provided by City Charter, actions are taken that would allow the project to occur. <br /> <br />Adopted this 12th day of February, 2007. <br /> <br /> <br />___________________________________ <br />Rob Marty, Mayor <br />ATTEST: <br /> <br /> <br />___________________________________ <br />Kurt Ulrich, City Administrator <br /> <br />(seal)
