<br /> <br />Harstad Wetland Permit <br />March 12, 2007 <br />Page 4 <br /> <br />It does not appear to be the case that there will be any appreciable soil loss from this site <br />as a result of the tree removal activity. <br /> <br />(13) Sediment and soil loss shall be determined utilizing the Universal Soil Loss Equation as <br />defined by the U.S. Dept of Agriculture Soil Conservation Service Technical Field Guide, as <br />amended from time to time, as provided for Ramsey Soil and Water Conservation District. <br /> <br />While duly noted, it does not appear to be the case that there will be any appreciable soil <br />loss from this site as a result of the tree removal activity. <br /> <br />(14) Only fill substantially free of chemical pollutants and wastes, as determined by the City, <br />may be used. <br /> <br />No fill will be brought onto this site as a result of the tree removal activity. This <br />requirement shall be stipulated regardless for future reference. <br /> <br />(15) A building's minimum elevation permitted in a wetland zoning district shall be as defined in <br />the Local Water Management Plan. <br /> <br />Building elevations will be addressed in conjunction with any subsequent grading and site <br />plans. For reference, the City’s Local Water Management Plan indicates the minimum <br />recommended building elevation on this parcel is 891.9 feet subject to any other <br />regulatory elevation which may be greater than that indicated. <br /> <br />(16) No alteration shall be allowed which will endanger the health, safety or welfare of persons <br />or which may result in unusual road maintenance costs or utility line breakages due to soil <br />limitations, including high frost action. <br /> <br />It is not anticipated that the removal of the trees from this tract of land would endanger <br />the health, safety or welfare of persons or result in unusual road maintenance costs or <br />utility line breakages. <br /> <br />(17) Scheduling of Work: Work in the wetland will not be performed during the breeding season <br />of water fowl or fish spawning season. <br /> <br />City staff will coordinate with Rice Creek Watershed District and the DNR to determine <br />the periods of time where development would be prohibited for these reasons. <br /> <br />(18) Size of Area: The size of the altered area shall be limited to the minimum required for the <br />proposed action. <br /> <br />It is the contention of Mr. Harstad that the extent of the tree removals on the Longview <br />parcel represents the minimum required for the proposed activity. <br /> <br />In addition to the above eighteen criteria for approval, the City Code in Section 1010.08, <br />Subd. 5 outlines six additional criteria which would warrant permit denial when and where <br />applicable.
