<br />Harstad Wetland Permit <br />March 12, 2007 <br />Page 5 <br /> <br />(1) No wetland alteration or wetland buffer permit may be granted which would allow any use <br />that is prohibited in the zoning district in which the property is located. <br /> <br />The permit requested would allow ONLY for tree removal from the Longview tract of land. <br /> Any subsequent development, grading, construction or alteration would require <br />reconsideration of the permit. That said, the anticipated proposed single-family <br />residential development would be consistent with the zoning district in which the parcel is <br />located. <br /> <br />(2) No wetland alteration or wetland buffer permit may be granted which would result in <br />incompatible land uses or which would be detrimental to surface and ground water resources. <br /> <br />The anticipated proposed development on this site is single family residential dwellings, <br />consistent with adjoining development. <br /> <br />(3) No wetland alteration or wetland buffer permit may be granted which would increase the <br />financial burdens imposed on the community through increasing floods and overflow of water <br />onto land areas within this City or onto land areas adjacent to Rice Creek. <br /> <br />It is not believed that the removal of trees would increase the financial burdens through <br />increasing floods and overflow of water onto land areas within this City. <br /> <br />(4) No wetland alteration or wetland buffer permit may be granted which would not be in <br />keeping with land use plans and planning objectives for the City or which will increase or cause <br />danger to life or property. <br /> <br />While certainly a loss on many levels, the removal of trees is not in and of itself <br />contrary to the land use plans and planning objectives of the City. When planning for <br />development, the preservation of significant trees where appropriate and desirable will <br />be encouraged. <br /> <br />(5) No wetland alteration or wetland buffer permit may be granted which would be inconsistent <br />with the objectives of encouraging land uses compatible with the preservation of the natural land <br />forms, vegetation and wetlands within the City. <br /> <br />A tree preservation ordinance is presently being drafted which would strengthen the <br />City’s ability to control the removal of trees regardless of whether development is <br />occurring. Ultimately, the land uses proposed on this site would not be incompatible with <br />the ideals noted and such a preservation ordinance, if adopted, would not preclude or <br />prohibit the removal of trees associated with a development project. <br /> <br />(6) No wetland alteration or wetland buffer permit may be granted which would include <br />development of land and water areas essential to continue the temporary withholding of rapid <br />runoff of surface water which contributes to downstream flooding or water pollution or <br />development of land and water areas which provide ground water recharge. <br /> <br />The tree removals from the Longview site would not cause any of the identified issues. <br />
