Item No. 7G <br />Type of Business: CB <br />Meeting Date: April 9, 2007 <br />City Administrator Review: ______ <br /> City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Assistant to the City Administrator <br />Item Title/Subject: Consider Resolution 7047, Approving an Off-Sale 3.2 Malt <br />Liquor License for Aldi Foods located at 2537 County <br />Highway 10 (Postponed from the March 26, 2007 Council Mtg) <br /> <br />Introduction: <br /> <br />Aldi Foods will be opening their store on May 1, 2007 at Mounds View Square. Aldi has <br />applied for an Off-Sale 3.2% Malt Liquor License to sell wine coolers along with their food <br />and other general items. City Code Chapter 503 establishes the process and conditions by <br />which such applications are reviewed and considered, and all such applications shall be <br />reviewed and approved by the Mounds View City Council. Section 503.04 Subd 2(d) also <br />requires that no license shall be issued to a facility located within 500 feet of any church or <br />school. <br /> <br />Police Inquiry and Investigations <br />The report from the Minnesota Bureau of Criminal Apprehension for Aldi Foods has not yet <br />been received. The license would be approved pending a satisfactory report. <br /> <br />Utility Billing Inquiry (City of Mounds View) <br />No outstanding utility bills. <br /> <br />Fire Inspection (City of Mounds View Fire Marshal) <br />Aldi Foods has submitted building permit applications. When construction is complete, <br />occupancy may not occur until a successful final inspection has occurred and certificate of <br />occupancy issued. <br /> <br />Chapter 503 Setback Requirement <br />As stated in the introduction, the Code indicates that no off-sale licensed premises shall be <br />within 500 feet of a school or a church. This is important because directly across the Long <br />Lake Road from Mounds View Square is Sunrise United Methodist Church. The Code <br />does not, however, instruct staff as to how such a measurement should be taken. The City <br />Council raised the issue of whether this establishment complies with Chapter 503 and <br />decided to postpone action to allow staff an opportunity to make a determination. <br /> <br />After the meeting on March 26, 2007, the following measurements were taken: <br /> <br />Property line to property line: 75 feet <br />Building to building: 255 feet <br />Front door to front door: 480 feet (as the crow flies) <br />Front door to front door: 545 feet (as the crow walks) <br />
