9-1-16 9-1-16 <br /> A) Many or most of the businesses in the downtown commercial core area of <br /> the City do not meet current off-street parking requirements. In order to <br /> preserve and protect downtown core businesses that may be destroyed by <br /> fire or other casualties, it is the purpose of this Section to allow the <br /> rebuilding of a downtown core business that has been destroyed, without <br /> having to comply with the current off-street parking ordinance. For that <br /> purpose the Parking Overlay is created. <br /> B. Application of Section 9-1-17 and Conflicts with Zoning Regulations: <br /> Section 9-1-17 of this City Code pertaining to off-street parking and loading <br /> shall apply to all zoning districts within the City except as hereinafter <br /> provided. If any of the regulations in this Section conflict with the <br /> regulations or requirements of Commercial "D" Zone, then the regulations <br /> or requirements of Commercial "D" Zone shall control. <br /> C. Parking Overlay "PO" Zone: <br /> 1. The following described real property located in the City of Mountain <br /> Home, County of Elmore, State of Idaho, is hereby declared to be a part of <br /> Parking Overlay "PO" Zone and the uses permitted and regulations per- <br /> taining to said property shall be the same as prescribed by ordinance for <br /> Parking Overlay "PO" Zone: <br /> Blocks One, Two, Three, Four, Five, Six, Seven, <br /> Eight, A and B; and the West one-half of Blocks <br /> Nine, Ten, Eleven, Twelve and C of the Mountain <br /> Home Original Townsite as the same appear on the <br /> Ver' i;; official plat thereof on file and of record in the office <br /> ` of the County Recorder of Elmore County, Idaho. <br /> 2. Off-street parking and loading areas now existing in the Parking Overlay <br /> "PO" Zone shall not be reduced or eliminated due to the expansion, en- <br /> largement or reconstruction of an existing building in the Parking Overlay <br /> "PO" Zone, except when such reduction complies with the current off- <br /> street Chapter, Section 9-1-17 of this City Code. <br /> 3. Commercial buildings now existing in the Parking Overlay "PO" Zone <br /> that do not comply with the current City off-street parking regulations <br /> (Section 9-1-17) that are destroyed by fire or other casualties, <br /> condemnation or are intentionally demolished, when rebuilt, must have the <br /> same number of off-street parking and loading spaces that existed prior to <br /> the destruction of the building. Buildings that are rebuilt after being <br /> destroyed shall conform to all of the requirements of Section 9-1-17 of this <br /> City Code, except the number of required parking and loading spaces and <br /> landscaping. <br /> 4. Any new building or other use on a parcel of land in the Parking <br /> Overlay "PO" Zone that was not previously developed for commercial use <br /> shall-conform n--9=1-1-7 of-this-City--Code. <br /> 5. The use of commercial buildings or land within the Parking Overlay "PO" <br /> Zone may be changed from one use to another without having to comply <br /> with Section 9-1-17 of this City Code.
