<br /> <br />Mounds View Matters <br />July-August, 2007 <br /> <br />City Wetland Regulations Updated <br /> <br />Recently the Mounds View City Council <br />approved an ordinance that amended <br />Chapter 1010 of the City Code pertaining <br />to wetlands and wetland management. <br />The ordinance (Ordinance 786) clarified <br />that residents who live within 100 feet of a <br />wetland do not need to obtain a special <br />wetland permit to conduct normal and <br />typical yard and lawn maintenance and <br />upkeep activities. Also clarified was that <br />the City or agents working at the direction <br />of the City do not need to obtain a wetland <br />permit when operating in the course of <br />normal municipal functions, such as park maintenance, installation of trailways, utility <br />maintenance, etc. Finally, the other amendment adopted by the Council was to strengthen <br />and clarify the enforcement provisions of the chapter to ensure that the City can effectively <br />and quickly respond to violations of the City’s wetlands regulations. <br /> <br />None of the amendments adopted by the City Council changes the fact that wetlands are <br />protected areas and that Rice Creek Watershed District (RCWD) is the responsible <br />governmental unit having jurisdiction over all wetland areas. No person shall engage in <br />development, alteration or construction activity, except as stated above, within a city- <br />designated wetland or wetland buffer without first obtaining a permit from the City.
