He then said that Staff feels that 6:00 a.m. is a little early and this amendment to 1 <br />the Ordinance would bring this portion of the ordinance more in line with the nuisance ordinance 2 <br />not allowing construction to begin before 7:00 a.m. 3 <br /> 4 <br />Staff reviewed the proposed language changes and suggested allowing work on Sundays from 5 <br />10:00 a.m. to 6:00 p.m. to give flexibility to residents who do want to work on their home but 6 <br />provide some assurance that the next door neighbor would not be awakened by the construction 7 <br />noise. 8 <br /> 9 <br />Council Member Stigney said that a lot of roofing takes place over the weekends so he has an 10 <br />issue with limiting timing because if they are doing a roof that needs to go until it is done. 11 <br /> 12 <br />Director Ericson said that the Code does not allow working on your house on Sundays right now. 13 <br /> 14 <br />Council Member Flaherty said that he hates to legislate when people can work on their own 15 <br />homes so he is okay with Monday through Sunday. 16 <br /> 17 <br />David Jahnke of 8428 Eastwood Road said that work is done on weekends now and neighbors do 18 <br />not seem to have an issue with it. 19 <br /> 20 <br />Council Member Mueller suggested sunup to sundown. 21 <br /> 22 <br />Council Member Flaherty would prefer the 7:00 a.m. to 10:00 p.m. Monday through Sunday. 23 <br /> 24 <br />Council agreed. 25 <br /> 26 <br />MOTION/SECOND: Mueller/Hull. First Reading and Introduction of Ordinance 792, an Ordinance Amending 33 <br />Chapter 1202 (Subdivision Plats and Procedures) of the Mounds View 34 <br />Municipal Code 35 <br /> 36 <br />Community Development Director Ericson explained that this would provide a way for the City 37 <br />to require other conditions if they are reasonable and related to the project. Staff and the City 38 <br />Attorney is recommending approval of introduction of this Ordinance. 39 <br /> 40 <br />Council Member Mueller asked whether someone could suggest that the City used aesthetics to 41 <br />discriminate against the project. 42 <br /> 43 <br />Council discussed it briefly and gave examples of what the term aesthetics meant and how they 44 <br />read it. 45
