Resolution 8005 Page 2 3. The proposed produce stand would not be out of place given the commercial and industrial character of the surrounding area involved. <br /> <br />4. The proposed produce stand would not depreciate the neighboring properties. <br /> <br />5. The applicant has sufficiently demonstrated that a need exists. <br /> <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council <br />approves the conditional use permit for the seasonal produce stand, with conditions as <br />follows: <br /> <br />1. The produce stand shall be allowed to operate from approximately June 20th to <br />September 3rd of each year. <br /> <br />2. The hours of operation of the stand shall not exceed 8:00am to 9:00pm. <br /> <br />3. Signage shall be allowed only as affixed to the gazebo base and/or roof. <br /> <br />4. Lighting for the use shall be supplied by existing parking lot standards. <br /> <br />5. The applicant shall provide the following on an annual basis to the City of <br />Mounds View Community Development Director: <br /> <br />a. Letter of permission from property owner. <br />b. Drawing of site plan. <br />c. Narrative description of the proposal. <br /> <br />6. This Conditional Use Permit may be reviewed by the Planning Commission and <br />City Council if any problems develop or if there are any changes to the operation <br />deemed substantial enough to warrant such a review, in the estimation of the <br />Community Development Director or the City Council. <br /> <br />NOW THEREFORE, BE IT FURTHER RESOLVED that this Conditional Use Permit <br />shall have no expiration date and shall remain in force so long as the conditions agreed <br />upon herein are observed. <br /> <br /> <br />Adopted this 11th day of June 2007. <br /> <br /> <br />_____________________________________ <br />Rob Marty, Mayor <br />ATTEST: <br /> <br /> _____________________________________ <br />Kurt Ulrich, City Clerk/Administrator <br />(SEAL)
