Mounds View City Council June 11, 2007 <br />Regular Meeting Page 6 <br /> <br />Council Member Stigney said that he is confused because Robert Waste is not a party to this and 1 <br />asked whether the Chief feels that he should be held accountable and whether the license should 2 <br />not be renewed because of activities in the building. 3 <br /> 4 <br />Council Member Flaherty asked if there was a way to find out where the alcohol was purchased 5 <br />from. 6 <br /> 7 <br />Chief Sommer indicated it would be difficult to do so. He then said that Edward Waste stated 8 <br />that he purchases the alcohol retail from either Vino & Stogies or other liquor stores. 9 <br /> 10 <br />Council Member Flaherty asked whether the alcohol came from Mr. Waste’s store. He then 11 <br />asked how a residence and a business exist in one building at the same address. 12 <br /> 13 <br />Community Development Director Ericson explained that the family bought the property back in 14 <br />the 1950’s prior to the enactment of the enactment of the Zoning Code so this is considered a 15 <br />legal nonconforming use. 16 <br /> 17 <br />Mayor Marty asked whether the central office or records from the security service could provide 18 <br />information on when the alarms are on and off. 19 <br /> 20 <br />MOTION/SECOND: Marty/Mueller. To Move this to the June 25, 2007 Council Meeting to 21 <br />Consider Possibility of Non-Renewal and To Allow Time for Information to be Obtained from 22 <br />the Alarm Company and Authorize a Public Hearing to Consider Suspension of a Liquor 23 <br />License. 24 <br /> 25 <br />Mayor Marty said that the City Attorney would be at the June 25, 2007 meeting for guidance and 26 <br />there is still time to renew prior to expiration of the license. 27 <br /> 28 <br /> Council Member Mueller said that utility bills are behind and she would like to get that caught 29 <br />up. 30 <br /> 31 <br />Mayor Marty said he would like the fire inspection done so that Council can move forward with 32 <br />renewal if that is the desire of Council. 33 <br /> 34 <br />Mr. Waste indicated that the fire inspector had already been in to check. 35 <br /> 36 <br />Council Member Mueller asked whether Edward Waste or the other person involved in this 37 <br />incident is employed by Mr. Waste. 38 <br /> 39 <br />Mr. Waste said that they are not. 40 <br /> 41 <br />Council Member Stigney said that from the motion made it sounded as if Mr. Waste can’t prove 42 <br />his store was closed and locked then he should lose his license and he is not so sure that should 43 <br />be the case. 44 <br /> 45
