Mounds View City Council October 8, 2007 <br />Regular Meeting Page 3 <br /> <br /> 1 <br />Margaret Leutboushouof 2263 County Road H2 indicated that they recently bought this property 2 <br />and were unaware of these changes, and she has talked to Staff about this to see if there is any 3 <br />way to get this resolved. She then said that they bought the property and were told that there 4 <br />were no outstanding issues and they have had to pay for garbage and delinquent utilities and now 5 <br />this. 6 <br /> 7 <br />Hearing no further public comments, Acting Mayor Stigney closed the public hearing at 7:20 8 <br />p.m. 9 <br /> 10 <br />Interim Administrator Ericson explained that this has happened before and the recourse was for 11 <br />the buyer to take action against the previous property owner. In the past, the City has not reduced 12 <br />or waived the assessments. 13 <br /> 14 <br />Council Member Flaherty said that this surprises him and he wonders how that previous property 15 <br />owner could get away with this. 16 <br /> 17 <br />Council Member Flaherty indicated that he would like Staff to contact the title company 18 <br />regarding this. 19 <br /> 20 <br />A member of the audience recommended that the property owner check with her title insurance 21 <br />company as, if she purchased title insurance, they should pay this amount. 22 <br /> 23 <br />Ms. Labanshio indicated that she did call the title company and they told her that they called the 24 <br />City and were told that nothing was pending. 25 <br /> 26 <br />Council Member Mueller asked her when she purchased the property. 27 <br /> 28 <br />Ms. Labanshio indicated that the property was purchased in May. 29 <br /> 30 <br />MOTION/SECOND: Mueller/Hull. To Waive the Reading and Approve Resolution 7168, 31 <br />Adopting a Special Assessment Levy for Charges Abating a Nuisance Condition. 32 <br /> 33 <br />MOTION/SECOND: Flaherty/Mueller. To Amend to Not Include Ms. Labanshio Until Further 34 <br />Information is Received on This Property. 35 <br /> 36 <br />Acting Mayor Stigney explained that this is a private matter between this owner and the previous 37 <br />owner and should not be a City problem. 38 <br /> 39 <br /> Ayes – 2 Nays – 2(Stigney/Hull) Amendment failed. 40 <br /> 41 <br /> Ayes – 4 Nays – 0 Original Motion carried. 42 <br /> 43
