Belting Request <br />Jan 23, 2006 <br />Page 2 <br /> <br />Regarding the first option, the City Council should not simply waive the requirement to <br />provide the additional seven stalls as this would be precedent-setting and could be viewed <br />as an arbitrary decision by the City. A more appropriate solution might be for Dr. Belting to <br />apply for a variance which would be considered by the Planning Commission. The Planning <br />Commission only grants variances when there is demonstrable hardship, which in this case <br />may be evident. <br /> <br />Regarding the second option, Dr. Belting proposes that the seven stalls be made available <br />on the Community Center site. In all likelihood, there would not be the need to ever utilize <br />the spaces. Regardless, the seven most distant stalls from the Community Center could be <br />designated as overflow for Belting. In return for this consideration, Dr. Belting would be <br />willing to install a sidewalk to connect the two properties (which seems like a good idea <br />regardless) as well as possibly more landscaping. The Council may not support such an <br />encumbrance onto the Community Center property. <br /> <br />The last option would necessitate a further amendment to the Walgreens PUD to simply <br />identify the required number of parking stalls on the Belting site as 43, if developed <br />according to the approved plans of October 10, 2005. This option would be the most <br />straightforward and recognizes the fact that the site is within a PUD and as such certain <br />flexibility is possible (such as with parking) that would not otherwise be possible. Of the <br />three options, Staff recommends this third choice, but would further recommend that Dr. <br />Belting install a connecting sidewalk between the two properties if feasible. It may not be <br />feasible to have a sidewalk lead into a bank of parking stalls however without adequate <br />space to walk between the cars. Staff will investigate this feasibility and report back to the <br />Council Monday evening. <br /> <br /> <br />Recommendation: <br /> <br />Dr. Belting requests that the City Council consider an action to either reduce the number of <br />parking stalls required for his office building between Walgreens and the Community center <br />or allow proof of parking to be identified on the Community Center site. Staff feels <br />comfortable that there are a sufficient number of parking stalls on the site to satisfy the <br />demands of the office tenants, a belief shared by Dr. Belting, and would support an <br />amendment to the PUD. If the Council is opposed to any of the options, Dr. Belting would <br />need to scale back the size of the building to adjust for the parking limitations.
