Mounds View City Council January 23, 2006 <br />Regular Meeting Page 8 <br /> <br />Finance Director Beer reported franchise fees of $265,000 for the General Fund and $265,000 for 1 <br />the Street Improvement Fund are included in the 2006 budget. 2 <br /> 3 <br />Finance Director Beer stated that if approved by the City Council, the ordinance will then be 4 <br />published in the New Brighton-Mounds View Bulletin and take effect 30 days after publication. 5 <br /> 6 <br />Mayor Marty opened the public hearing at 8:14 p.m. 7 <br /> 8 <br />There being no public input, Mayor Marty closed the public hearing at 8:14 p.m. 9 <br /> 10 <br />Councilmember Stigney questioned staff if Xcel Energy is agreeable to remove the language in 11 <br />the ordinance regarding waiving fees for ensuing years. Finance Director Beer stated that it has 12 <br />not been discussed yet. 13 <br /> 14 <br />Councilmember Stigney requested legal interpretation. City Attorney Riggs stated that the 15 <br />ordinance that goes into effect follows the franchise agreement and includes an agreement that 16 <br />the language can be taken out. He stated that this does not mean there might not be somewhat of 17 <br />an argument, but it is in control of the City. 18 <br /> 19 <br />Mayor Marty stated this item was prepared a little late this year. 20 <br /> 21 <br />Councilmember Stigney stated that once things take effect, sometimes it is kind of hard to correct 22 <br />them. 23 <br /> 24 <br />City Attorney stated that Finance Director Beer discussed the issue with Mark Vose and with 25 <br />Excel Energy. 26 <br /> 27 <br />Mayor Marty stressed next year this item should be taken care of in the fall. Finance Director 28 <br />Beer stated that it is on his calendar for August 1, 2006. 29 <br /> 30 <br />MOTION/SECOND: Gunn/Thomas. To waive the reading and adopt Ordinance 767, an 31 <br />Ordinance Implementing a Franchise Fee on Xcel Energy Electric and Natural Gas Operations 32 <br />within the City of Mounds View for the Year 2006. 33 <br /> 34 <br />ROLL CALL VOTE: 35 <br /> 36 <br />Mayor Marty Aye 37 <br />Councilmember Gunn Aye 38 <br />Councilmember Stigney Aye 39 <br />Councilmember Thomas Aye 40 <br /> 41 <br /> Ayes – 4 Nays – 0 Motion carried. 42 <br /> 43
