He stated there is nothing that is 1 <br />interrupting the Council. 2 <br /> 3 <br />Councilmember Thomas noted it would have to be taken off the table. 4 <br /> 5 <br />Mayor Marty commented that he could see how voting would put the Council in a situation it 6 <br />may not want to be in. 7 <br /> 8 <br />Councilmember Stigney suggested another way to handle the item is to postpone it indefinitely, 9 <br />retract the motion of denying it, and change the motion to postpone it indefinitely and take no 10 <br />action, so as not to take a stand on the item. 11 <br /> 12 <br />Councilmember Thomas suggested no action is necessary if the motion is withdrawn. She 13 <br />pointed out that a vote is not required just because a resolution is put in front of the Council. 14 <br /> 15 <br />City Administrator Ulrich stated that one option is to make a motion to postpone the item 16 <br />indefinitely. 17 <br /> 18 <br />Councilmembers Stigney and Gunn agreed to retract the motion on the floor. 19 <br /> 20 <br />SUBSTITUTE MOTION/SECOND: STIGNEY/GUNN. To postpone indefinitely Resolution 21 <br />6761 A Resolution Supporting the Constitutional Amendment for Motor Vehicle Sales Tax 22 <br />Dedication to Transportation. 23 <br /> 24 <br />Councilmember Flaherty stated he agreed with Councilmember Thomas that the resolution 25 <br />should not be in front of the Council. He pointed out that 46 percent of the State’s General Fund 26 <br />works out to be approximately $130 to $150 million. He stated the amendment is too ambiguous 27 <br />to support one way or the other. 28 <br /> 29 <br /> Ayes – 5 Nays – 0 Motion carried. 30 <br /> 31 <br />C. Resolution 6758 Approving Contract Award Regarding Easement Clearing 32 <br />for Edgewood Drive and Bona Road. 33 <br /> 34 <br />Director of Public Works Lee explained there is a ponding problem to the rear of properties on 35 <br />Bona Road and Edgewood Drive, and it was found that the drainage easement to the rear of the 36 <br />properties is not functioning as originally intended. He stated Staff is recommending to correct 37 <br />this situation by repairing the drainage easement and reestablishing it to the grades that were 38 <br />approved under the original grading plan. 39 <br /> 40 <br />Director of Public Works explained Staff received two quotes, and the low quote was from 41 <br />Mattco Excavating in the amount of $15,230. Staff recommends awarding Mattco Excavating 42 <br />with the contract to perform the work, as per the City’s recently adopted Easement Use and 43 <br />Restoration policy. 44 <br /> 45
