Outdoor Alcohol Consumption <br /> Chapter 100 of the City Code currently prohibits the possession and <br /> consumption of alcohol in parking lots and other outdoor areas of on- and <br /> off-sale liquor establishments. This part of the code has not been <br /> enforced at outdoor concerts . If the Council decides to continue to allow <br /> alcohol at outdoor concerts, the Code should be amended to reflect this. <br /> A temporary permit could be issued which would allow outdoor alcohol <br /> consumption under certain conditions . Some conditions that might be <br /> required include the complete fencing of the area in which the alcohol is <br /> to be served and a ban on glass containers in the outdoor area. <br /> 2 . Hours of Operation <br /> In order to remain consistent with the Nuisance section of the Code, any <br /> outdoor concert should be required to end by 10:00 p.m. <br /> 3. Noise <br /> Noise is an extremelydifficultaspect of outdoor Concerts to regulate. A <br /> maximum decibel level could be set, but enforcement of that maximum <br /> becomes problematic, as the City would need to purchase measuring devices <br /> and to train staff in its use. Determining a maximum level would be <br /> difficult as well, since intolerable vol = subjective determination. <br /> ' :ul Harrington,7City Planner <br /> RECOMMENDATIONz <br />
