Mounds View City Council August 14, 2006 <br />Regular Meeting Page 8 <br /> <br /> 1 <br />Councilmember Thomas addressed the citizens’ concerns. She stated she does not believe the 2 <br />vacation of the easement dramatically changes where the house will be located. She stated the 3 <br />request is reasonable and will not cause any problem to adjoining property. She stated she does 4 <br />not understand the concern. 5 <br /> 6 <br />Councilmember Gunn asked about the setback from the road. Director Ericson replied the 7 <br />building does meet the 30-foot minimum setback requirement He noted that most of the homes 8 <br />are setback 30-35 feet. 9 <br /> 10 <br />Councilmember Flaherty noted that the property must be graded properly. Director Ericson 11 <br />replied that the area will not need additional grading and the vacation will serve as a walkout 12 <br />area. He stated that the builders would ensure that it is at least 100 feet from the high-water 13 <br />level. He stated after the vacation is completed, the City has requested developer will submit a 14 <br />as-built plan showing correct grading. 15 <br /> 16 <br />Mayor Marty asked who has paid for the engineering firms. Director Ericson replied that the 17 <br />developer has paid for the engineering consulting. 18 <br /> 19 <br />Councilmember Stigney asked if curb appeal would be harmed with the home set back further 20 <br />than the others. He mentioned that the home on Lot Five would be setback 40 feet rather than 21 <br />the 30 feet. Director Ericson noted that the garage is being set out in front of the house and will 22 <br />be somewhat different because of the issues surrounding it being a handicapped-accessible home. 23 <br />He stated there are not sufficient differences in the home that will degrade the value of other 24 <br />homes. 25 <br /> 26 <br />Dave Regal, of Dave Regal Construction, explained the house is setback an additional five feet 27 <br />because the driveway is too steep for a wheelchair. 28 <br /> 29 <br />MOTION/SECOND: THOMAS/FLAHERTY. To waive the reading and adopt Ordinance 777, 30 <br />an Ordinance Vacating Part of a Drainage and Utility Easement Associated with Lot 5, Hidden 31 <br />Hollow and approving publication.
