Resolution 6917 Authorization to Hire a Replacement Police Officer for the 2 <br />Mounds View Police Department. 3 <br /> 4 <br />Police Chief Sommer stated there is a current opening and there is an existing list of potential 5 <br />officers and the next person on the list will fill the opening. He stated the next person on the list 6 <br />is Nicholas Erickson who has completed all but two tests. He stated Staff recommends 7 <br />approving Nicholas Erickson as a police officer contingent on passing psychological and medical 8 <br />tests. 9 <br /> 10 <br />MOTION/SECOND: FLAHERTY/THOMAS. To waive the reading and adopt Resolution 11 <br />6917, Authorization to Hire a Replacement Police Officer for the Mounds View Police 12 <br />Department. 13 <br />Ayes – 5 Nays – 0 Motion carried. 14 <br /> 15 <br />J. Resolution 6903 Severance payment for Thomas Baumgart, Mounds View 16 <br />Police Officer 17 <br /> 18 <br />Assistant to the City Administrator Crane stated Thomas Baumgart was terminated from his 19 <br />position due to his inability to perform the essential functions of a police officer as concluded by 20 <br />his health care provider. She stated the termination was effective July 10, 2006. She added that 21 <br />the draft Resolution authorizes a severance payment to Mr. Baumgart for his accrued 22 <br />compensatory and vacation time. She noted the payment is in accordance with the Mounds View 23 <br />Personnel Manual and the current LELS Police Officers Labor Agreement. 24 <br /> 25 <br />Assistant to the City Administrator Crane stated the resolution provides a payout of Mr. 26 <br />Baumgart’s vacation hours, which is $5,458.20. She noted it was calculated as 181.94 hours 27 <br />times his hourly salary of $30.00. She added that the Resolution also provides for a payout of 28 <br />his compensatory time, which is $337.50. She noted it was calculated as 11.25 hours times his 29 <br />hourly rate of $30.00. 30 <br /> 31 <br />Assistant to the City Administrator Crane stated it has also come to Staff’s attention that the City 32 <br />may be responsible for the continued contribution payment of Mr. Baumgart’s health insurance, 33 <br />in accordance with Minnesota State Statute 299A.465, subd 1. She read from the Statue which 34 <br />states: “The employer is responsible for the continued payment of the employer’s contribution for 35 <br />coverage of the officer or firefighter and, if applicable, the officer’s or firefighter’s dependents. 36 <br />Coverage must continue for the officer of dependents until the officer of firefighter reaches age 37 <br />65. However, coverage for dependents does not have to be continued after the person is no 38 <br />longer a dependent.” 39 <br /> 40 <br />Assistant to the City Administrator Crane stated that Staff recommends severance payment to 41 <br />Thomas Baumgart in accordance with the current LELS Police Officers Labor Contract in the 42 <br />amount of $5,795.70. 43 <br /> 44 <br />Assistant to the City Administrator Crane noted e-mail from Mr. Alsop, Kennedy and Graven, 45
