Mounds View City Council October 23, 2006 <br />Regular Meeting Page 8 <br /> <br />property maintenance code and notice was issued to the property owner and there were two 1 <br />instances of not maintaining the building and notices were issued for that as well. A follow up 2 <br />inspection was completed in September and Staff met with the owner of record and the owner 3 <br />informed Staff that none of the noted items were repaired and three of the four units were vacant. 4 <br /> 5 <br />Inspector Jeremiah Anderson indicated that the property owner has indicated he does not have 6 <br />the rental income to satisfy the mortgage obligation and is not sure how he is going to handle the 7 <br />disposition of the building as he is in foreclosure. Staff explained to the property owner that 8 <br />authorization would be sought from the Council for non-renewal of the multiple dwelling license 9 <br />for failure to correct deficiencies of the maintenance code and submission of the license 10 <br />requirements for renewal. The owner of record was notified to come to the meeting. 11 <br /> 12 <br />Inspector Jeremiah Anderson indicated that he spoke to the resident occupying the one unit and 13 <br />Staff informed them of the situation going on. 14 <br /> 15 <br />Council Member Thomas said that she is concerned about the occupying resident and she has no 16 <br />desire to see them evicted and she would like to work within the Code and allow the rental some 17 <br />how. She then said that she would hate to evict someone who could potentially work out a rental 18 <br />agreement with the new owner once the building is sold. 19 <br /> 20 <br />Council Member Stigney said that he would be concerned if the building does not meet Code to 21 <br />allow someone to continue to live there. He then asked if Staff knows what the rental 22 <br />arrangements are. 23 <br /> 24 <br />Inspector Jeremiah Anderson indicated that he is not sure what the rental arrangements are and 25 <br />Staff usually does not get involved with that but Staff can facilitate a meeting with the owner of 26 <br />record and the property owner. 27 <br /> 28 <br />Inspector Jeremiah Anderson indicated that Council can decide how to proceed with this and 29 <br />Staff has recommended non-renewal for the entire property but would not want to see someone 30 <br />evicted. 31 <br /> 32 <br />Council Member Gunn indicated it would be a hardship for the renter to have to find another 33 <br />place to live simply because the landlord is not in compliance. 34 <br /> 35 <br />Mayor Marty said that the proposed 30 days is a short window of time for the tenant to locate 36 <br />another place to live but, he would like to set a date certain to have the situation corrected. He 37 <br />then suggested 60 to 90 days for the situation to be corrected unless there is a health and safety 38 <br />issue at the property. 39 <br /> 40 <br />Director Ericson suggested a way to amend the Resolution to not renew the license for the three 41 <br />units and, once the other unit becomes vacant then it is not valid for further rental along with 42 <br />tying in a timeframe to bring the property into compliance. Staff would recommend an 43 <br />immediate inspection to ensure that there are no immediate heath, safety, or welfare issues posing 44 <br />a threat to the tenant. 45
