He further said that he has rated her performance 1 <br />satisfactory and noted there were some issues that Council wished to address in executive session 2 <br />and, upon receipt of her resignation, that meeting was canceled. 3 <br /> 4 <br />City Administrator Ulrich recommended approval of the step increase of 5% from October 17 to 5 <br />November 28, 2006. He then noted that the Union has filed a grievance and the claim of the City 6 <br />is that the personnel policy states that Council must approve any step increases and the Union is 7 <br />prepared to argue that point. 8 <br /> 9 <br />Council Member Flaherty asked what the dollar amount would be. 10 <br /> 11 <br />City Administrator Ulrich indicated it would be an increase from $18.31 to $19.46 per hour so a 12 <br />dollar an hour for about five weeks for an approximately amount of $200 to $250. 13 <br /> 14 <br />Council Member Stigney said that it seems to him that the contract language and the Union 15 <br />interpretation is saying that by the time the six month review is due it is too late to do anything 16 <br />about it so he would like to review this to see what can be changed so that these types of 17 <br />situations do not turn into a legal operation. 18 <br /> 19 <br />City Administrator Ulrich indicated it would be easier to handle this during a probation period. 20 <br />He then recommended that the HR Committee recommend a policy of red flagging reviews for 21 <br />employees on probation before the probation period is up. 22 <br /> 23 <br />Mayor Marty agreed that in order to deny the step increase City Council would need to have 24 <br />executive sessions to document reasons for the delay of step increase. He then said that he would 25 <br />like to have the personnel policy amended and the policy brought back before Council after 26 <br />recommendation by the HR Committee. 27 <br /> 28 <br />Mayor Marty indicated that the City is over a barrel because the six month probationary period 29 <br />came and went and he does not feel it is worth pushing this at this time. He then read language 30 <br />from the Code which indicated that, after the six month probationary period is over, there is a 31 <br />stronger requirement to show that the employee is not performing satisfactorily. 32 <br /> 33 <br />Mayor Marty indicated that he would like all of the positions for step increases to be brought to 34 <br />the Council prior to the anniversary date from now on. 35 <br /> 36 <br />MOTION/SECOND: Flaherty/Gunn.
