Phasing of this project <br />Staff presented an option (based on current information) to do the area east of <br />Long Lake Road in 2007 and the area west in 2008. Council indicated that this <br />could be an option to consider. Staff did indicate that contractors may be <br />consulted on this issue. <br /> <br /> <br /> <br />Discussion: <br /> <br />Preliminary Report - On the basis of the City Council's previous action, a <br />Preliminary Report has been prepared. Based upon this analysis the project is <br />felt to be necessary, cost effective and feasible. A copy of the FINAL VERSION <br />of the Feasibility Report is attached for the Council's review. <br /> <br /> <br />Public Improvement Hearing – The purpose of the Public Improvement Hearing <br />is to provide interested parties an opportunity to learn more about the proposed <br />improvements and to comment on them. Pursuant to Resolution 6959 a Public <br />Hearing was set for December 11, 2006. <br /> <br />As per State Statute 429.031: “Before the municipality awards a contract for an <br />improvement or orders it made by day labor, or before the municipality may <br />assess any portion of the cost of an improvement to be made under a <br />cooperative agreement with the state or another political subdivision for sharing <br />the cost of making the improvement, the council shall hold a public hearing on <br />the proposed improvement following two publications in the newspaper of a <br />notice stating the time and place of the hearing, the general nature of the <br />improvement, the estimated cost, and the area proposed to be assessed.” <br /> <br />Notice of this hearing was mailed to each parcel within the area proposed to be <br />assessed on November 14, 2006. The mailing was sent to owners as shown on <br />the records of Ramsey County as per state statute. <br /> <br />The hearing was advertised in the City’s official newspaper, The New Brighton- <br />Mounds View Bulletin, on November 22nd and 29th of this year. The Public <br />Hearing Notice and information on this project was also published on the City’s <br />web site. <br /> <br /> <br />What’s Next – Following the Public Hearing for this proposed project, Chapter 8 <br />Section 8.04 states, “A period of sixty days shall elapse after the public hearing <br />before any further action shall be taken by the Council on the proposed <br />improvement.” During this time Staff will work and meet with property owners to <br />address any issues. Staff will also continue to work with the Rice Creek <br />Watershed District to resolve any issues that would prevent the issuance of a <br />permit. Staff will also continue to collect public input pertaining to issues <br />discussed at the Public Informational Meeting and noted on feedback forms <br />received.
