40,A 5 <br /> • MEMO TO: MAYOR AND CITY COUN <br /> iA. <br /> FROM: CLERK-ADMINISTRATO i .4 ), <br /> DATE: MARCH 28, 1990 <br /> SUBJECT: ANNEXATION <br /> City Councilmember Gary Quick requested that I investigate the <br /> issue of the City annexing that portion of land involved in <br /> the New Highway 10/610 project between the center line of <br /> existing County Road J and the center line of the proposed <br /> realigned County Road J. <br /> Minnesota Statutes 414 regulates the incorporation, <br /> detachment, or annexation of incorporated and unincorporated <br /> lands within the State of Minnesota. Specifically, M.S. <br /> 414.061, copy attached, addresses the issue of concurrent <br /> detachment and annexation of incorporated land. This section <br /> provides that either by resolution of both municipalities <br /> involved in the detachment and annexation process or a <br /> petition of all property owners, the municipal board may order <br /> detachment of incorporated lands from one municipality and <br /> concurrent annexation to the abutting municipality. This <br /> • process, if begun by resolution of the two cities, may be <br /> accomplished by order of the municipal board, however, if <br /> begun by means of a petition of all property owners, the <br /> municipal board must conduct a public hearing prior to the <br /> detachment and annexation decision being made. Any decisions <br /> of the municipal board are appealable to the district court <br /> pursuant to 414.07. <br /> After reviewing State Statutes I contacted staff members of <br /> the municipal board who confirmed that the aforementioned <br /> statutory sections are the only ones which apply to this <br /> situation.
