• MEMO TO: MAYOR AND CITY COUN' <br /> FROM: CLERK-ADMINISTRATsi10111 <br /> DATE: MARCH 26, 1990 <br /> SUBJECT: REVISED MUNICIPAL CODE CHAPTER 104, GARBAGE AND <br /> RUBBISH <br /> Attached please find the most recent draft of proposed <br /> revisions to Chapter 104 of the Municipal Code entitled, <br /> "Garbage and Rubbish" dated March 26, 1990. This draft has <br /> been discussed with City Attorney Karney but not reviewed by <br /> him at this time. Staff will be requesting his review and <br /> written response for the April 2nd Agenda Session. <br /> The following is a summary of the major changes made to <br /> Chapter 104 in response to Council directive and to address <br /> problems currently being experienced in the City with respect <br /> to garbage, rubbish and recyclable disposal. The changes by <br /> section are as follows: <br /> 1. 104 .01 Definitions. The following definitions have <br /> • have been added. Yard waste, residents, <br /> multiple dwelling, commercial establishment, <br /> mobile home park and recyclable materials. <br /> Also, the definition for rubbish has been <br /> revised to reflect that rubbish is all non- <br /> recyclable inorganic matter. <br /> 2 . 104.02 has been revised to make it a misdemeanor for <br /> anyone in the City to dispose of garbage and rubbish <br /> off of their property without using a licensed hauler <br /> or having the written permission of the property owner <br /> where the garbage or rubbish is being disposed. The <br /> purpose for this is to provide the City with some <br /> enforcement tool where we can charge individuals who <br /> dispose of their garbage and rubbish in City parks or <br /> on other private property without the permission of the <br /> property owner. Currently Code does not provide any <br /> language that would allow enforcement and this addition <br /> has been suggested to address that matter. <br /> 3. 104.04 adds under Subdivision 1 a requirement that yard <br /> waste and recyclables as well as garbage and rubbish be <br /> stored behind the front line of the building line for <br /> the width of the property except on collection days. <br /> Subdivision 2 provides that dumpsters used in <br /> conjunction with multiple dwellings and commercial <br /> • <br />
