111 <br /> PAGE TWO <br /> MARCH 26, 1990 <br /> establishments for the convenience of the property <br /> owner/renter or leasee be stored within an enclosure. <br /> Subdivision 3 provides that dumpsters intended for <br /> public collection of recyclable materials for <br /> charitable purposes may be located on a paved surface <br /> not designated for parking and clearly marked to <br /> reflect that fact. Subdivision 3, in particular, is <br /> being recommended because the City is beginning to <br /> experience, within the past few weeks, a proliferation <br /> of dumpsters on commercial properties for recycling <br /> purposes. The best example we can provide is a <br /> dumpster that was located on the Taco Bell site by <br /> Aagard Sanitation for recycling of cardboard outside of <br /> the enclosed area. This dumpster was placed in a <br /> parking stall by an unlicensed hauler. Because the <br /> Code does not provide that dumpsters must be in an <br /> enclosure nor does it prohibit placement of dumpsters <br /> in a parking stall, this addition is proposed and has <br /> been approved by City Attorney Barney to get control of <br /> the situation before dumpsters become more of an <br /> . eyesore in the community than currently exists. Staff <br /> would also encourage Councilmembers to view the rear of <br /> Mounds View Square on the County Road I side to notice <br /> the additional dumpsters that have been recently added <br /> to the site for recycling in addition to the dumpsters <br /> that are currently located there for garbage removal. <br /> This issue was discussed with the Mounds View Planning <br /> Commission at their March 21st meeting and they <br /> wholeheartedly endorsed the proposal to require that <br /> non-public dumpsters be placed in enclosures. <br /> 4. 104.07 Subdivision 10 sets forth the proposed <br /> requirements for recycling and yard waste handling by <br /> licensed haulers pursuant to Council direction. <br /> 5. 104.09 requires the reporting of recyclables and yard <br /> updated by haulers to the City on a quarterly basis and <br /> provides penalties should the reports not be submitted. <br /> This requirement is listed because the Metropolitan <br /> Council currently requires we provide reports on a <br /> quarterly basis and penalties are contained within <br /> statute should we not submit those reports in a timely <br /> fashion. We are only able to submit those reports if <br /> the haulers provide us with the information and the <br /> penalty is included in order to encourage the haulers' <br /> cooperation. <br />
