P <br /> J <br /> • MEMO TO: MAYOR AND CITY COUNCIL <br /> FROM: CLERK-ADMINISTRATOR <br /> DATE: MARCH 13, 1990 <br /> SUBJECT: MOUNDS VIEW BRANCH LIBRARY STORM WATER MANAGEMENT <br /> FEE <br /> As you may recall, representatives of the Ramsey County <br /> Library System requested that the City of Mounds View refund <br /> the storm water management fee charged for the Mounds View <br /> Branch Library. Attached for your information is a copy of <br /> their initial request dated December 9, 1989 and my response <br /> per Council direction dated January 4, 1990. After receiving <br /> this letter, Mr. Modris M. Feders of Buetow and Associates, <br /> Inc. , the library architect, continued to pursue the issue of <br /> the SWM fee with me in several phone conversations. During <br /> these conversations Mr. Feders that the SWM fee was left out <br /> of the bid specifications for the library because City staff <br /> had not adequately advised him or the contractor of the fact <br /> that this fee would be charged. I requested that Mr. Feders <br /> and the contractor place their allegations in writing and I <br /> would review these with the City staf members involved. <br /> Attached are copies of letters from Mr. Feders dated January <br /> 29, 1990 and Julius Webster of Frerichs Construction Company <br /> dated January 10, 1990. I also received a telephone call from <br /> Mr. Dave Nicolai, the construction manager for Ramsey County <br /> on the library project. Mr. Nicolai was very persistent in his <br /> position that the fee was not a usual fee charged by cities in <br /> the metropolitan area and City staff did not adequately advise <br /> the architect or contractors that this fee would be charged. <br /> In a meeting with staff members regarding these allegations <br /> including City Planner Hren, Building Official Tobias, Public <br /> Works Department Secretary Collins and Public Works Director <br /> Minetor, I was provided with the following information. Both <br /> Barb Collins and Ric Minetor recall mentioning the storm water <br /> management fee to individuals who talked to them about the <br /> library project but not giving any specific amount. Michelle <br /> Hren stated that she never had any conversation with <br /> representatives of the library board or contractors regarding <br /> fees for the project. Jim Tobias provided me with a copy of a <br /> worksheet listing an estimate of fees that would be charged <br /> for the project including a storm water management fee in the <br /> amount of $1,299 . Mr. Tobias used these calculations in <br /> response to calls from contractors who were preparing their <br /> bids on the project but does not recall talking specifically <br /> to Frerichs Construction. <br /> • <br />
