411 1. 07 <br /> • (b) If both of the sources adopted by reference are non- <br /> statutory, the provision drawn from the code or material most <br /> closely related to the chapter of this Code which is sought to be <br /> applied shall control. <br /> (5) If a provision or section of this Code conflicts <br /> with a provision or section of the Home Rule Charter, the Home Rule <br /> Charter shall prevail. <br /> 1.08 REPEAL OF ORDINANCES. All Ordinances of the <br /> Municipality heretofore adopted are repealed. <br /> 1.09 EXISTING RIGHTS AND LIABILITIES. The <br /> disposition by repeal of heretofore existing Ordinances of this <br /> Municipality and the new enactment of the provisions of this Code <br /> have been effectuated in compliance with the laws of the State of <br /> Minnesota. The procedures implemented are not to be construed so <br /> as to alter, diminish, increase or in any other manner affect <br /> rights and liabilities existing at the time of the repeal of <br /> heretofore existing Ordinances and the amendment of this Code. The <br /> provisions of this Code, insofar as they are the same in substance <br /> as those of heretofore existing ordinances, are essentially but not <br /> actually continuations of such Ordinances . Therefore, any acts <br /> done, offense committed, or rights accruing or accrued, or <br /> • liability, penalty, forfeiture, or punishment incurred or assessed <br /> prior tot he effective date of this Code is not affected by the <br /> enactment of this Code. <br /> 1. 10 ORDINANCES PREVIOUSLY REPEALED NOT RE-ENACTED. <br /> No Ordinance or part of any Ordinance heretofore repealed shall <br /> be considered reordained or re-enacted by virtue of the enactment <br /> of this Code unless specifically re-enacted. The repeal of any <br /> curative or validating Ordinance shall not impair or affect any <br /> cure or validation already affected thereby. <br /> 1 . 11 PENALTIES, ENFORCEMENT. <br /> Subdivision 1. Misdemeanors . Unless another penalty is <br /> expressly provided in this Code, and except for the provisions of <br /> Subdivision 2 hereafter, any person violating any provisions of <br /> this Code, or any rule or regulation adopted or issued in pursuance <br /> thereof, or any provision of any Code adopted herein by reference, <br /> shall upon conviction, be punished by a fine of not more than <br /> $700 . 00, or by imprisonment for not more than 90 days, or both. <br /> ( 168,268) <br /> Subdivision 2 . Petty Misdemeanors . Any person convicted <br /> of a petty misdemeanor shall be subject to a fine of not more than <br /> $100 . 00 . <br /> • <br />
