1. 11 • <br /> Subdivision 3 . Administrative Offenses . AnyP erson • <br /> violating an administrative rule shall be subject to the scheduled <br /> penalty not to exceed $100 .00 for each offense. <br /> Subdivision 4 . Separate Violations . Unless otherwise <br /> provided, each act of violation and every day upon which a <br /> violation occurs or continues constitutes a separate offense. <br /> Subdivision 5 . App±i-abi-lity. -The- penalties provided <br /> by this section or any section of this Code applies to the <br /> amendment of any section of this Code or any Code adopted herein <br /> by reference to which the penalty relates, whether or not such <br /> penalty is re-enacted in the amendatory provision, unless otherwise <br /> provided in the amendment. <br /> Subdivision 6 . Reference to Sections . Reference to any <br /> sections of this Code shall be understood also to refer to and <br /> include the penalty section relating thereto, unless otherwise <br /> expressly provided. <br /> Subdivision 7 . Failure of Officers to Perform Duties . <br /> The failure of any officer or employee of the Municipality to <br /> perform any official duty imposed by this Code shall not subject • <br /> such officer or employee to the penalty imposed for violation of <br /> this Code, unless a penalty is specifically provided for such <br /> conduct or omission. <br /> Subdivision 8. Non-Peace Officer Citations or <br /> Administrative Offenses . Non-peace officer employees that are <br /> specifically authorized herein may issue citations or <br /> Administrative Offenses as authorized pursuant to the following <br /> chapters of this Code: <br /> Chapter 39; Signs and Billboards: City Planner <br /> Chapter 40; Zoning: City Planner <br /> Chapter 42; Subdivision Regulations: City Planner <br /> Chapter 44; Streets, Driveways : Building Official <br /> Chapter 45; Relocation of Buildings Building Official <br /> Chapter 47; House & Building Numbers Community Service <br /> Officer <br /> Chapter 48; Wetland Zoning: City Engineer, City <br /> Planner <br />
