Mounds View Planning Commission June 4 , 1986 <br /> Regular Meeting Page Six <br /> Motion/Second: Forslund/Miller to approve Reso- <br /> lution No. 165-86. <br /> 3 ayes : 1 abstention Motion Carried <br /> Chairman Mountin abstained from the vote for previously <br /> mentioned reasons. <br /> Director Thatcher reviewed his memo of May 27, 1986 9 . Daryl Blasberg, <br /> to the Planning Commission, regarding the request of 8106 Groveland <br /> Daryl Blasberg to vacate an easement at 8106 Groveland Road, <br /> Road. Case 191-86 <br /> Ken Sjodin stated that there is a cloud on the title, <br /> and requested the City take action. stating that the <br /> easement is no longer needed and remove it from the <br /> property. <br /> Director Thatcher stated that they would need positive <br /> information from an attorney stating that there is a <br /> definite easement on the property and asking for it <br /> to be vacated. He explained that it is questionable <br /> whether an easement still exists on the property, and <br /> if it is removed, where it should go. <br /> 11 Mr. Sjodin stated that if an easement is required <br /> omewhere, Mr. Blasberg does not own the other land <br /> to grant another easement. <br /> There was considerable discussion as to whether an <br /> easement actually exists and what action should be <br /> taken. Director Thatcher stated he felt a legal <br /> opinion was necessary. <br /> Motion/Second: Mountin/Miller to table to the next <br /> agenda session and request that this item be referred <br /> to the City Attorney for his opinion, and further <br /> request that the applicant or his representative <br /> provide the Planning Commission with letters from the <br /> attorneys who have searched the title on this. The <br /> minutes should also be searched to the best of the <br /> City' s ability to see what happened to the easement. <br /> 4 ayes 0 nays Motion Carried <br /> The Planning Commission asked Director Thatcher to <br /> investigate the title insurance and what guarantees <br /> are provided, to whom, and get back to them. <br /> hairman Mountin reviewed proposed Resolution No.111, 10.
