No . <br /> 203-87 , <br /> Planner Herman reported a resolution has been prepared, Scott Hyser , <br /> denying the request, as no exceptional circumstances 7340 Spring <br /> could be found. Lake Road <br /> Chairman Mountin noted for the record that Mr. Hyser <br /> had been offered the opportunity at the September 16 <br /> agenda session to withdraw his request, and save the <br /> $50 fee, but he had stated he wanted to go on with it <br /> to the Council. <br /> Motion/Second: Zollner/Miller to adopt Resolution No. <br /> 203-87 , denying the variance request for Scott Hyser, <br /> 7340 Spring Lake Road, and waive the reading. <br /> 6 ayes 0 nays Motion Carried <br /> Chairman Mountin directed Planner Herman to send a <br /> letter to Mr. Hyser, informing him that the Planning <br /> Commission denied the variance request, and that if <br /> he would like to appeal the denial, he must goto <br /> the Council. <br /> •It was noted there was no one present to represent 9. Consideration <br /> the applicant. of Staff Report <br /> Regarding Exten- <br /> Planner Herman reported that Kunz Oil Company had sion of CUP <br /> been granted a conditional use permit on October 13, for Kunz Oil <br /> 1986 for a gas station and convenience store to be Company <br /> located on the present location of K-Gas at 2901 <br /> Highway 10, but after receiving the permit, they <br /> never took any action to begin construction. She <br /> explained that City code states that a conditional <br /> use permit becomes null and void if the work permitted <br /> is not completed within one year, unless a petition <br /> for an extension is filed with the City 30 days before <br /> "'the expiration date of the original permit. She noted <br /> that the request was received on September 24 , 1987 , <br /> which is less than the required 30 days. <br />
