RESOLUTION NO. 217-88 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION DENYING A VARIANCE REQUEST FOR DYNAMIC DESIGNERS, 7656 AND 7660 WOODLAWN DRIVE, MOUNDS VIEW PLANNING CASE NO. 138-83 WHEREAS, Chapter 48 of the Municipal Code sets require- ments for building within a wetland; and WHEREAS, Dynamic Designers have requested variances and a conditional use permit to build two fourplexes within Wetland 1-9 and the 100 foot buffer; and WHEREAS , there is a discrepancy between the lot size scaled off on the site plan dated January 12, 1988, and that of the Ramsey County records; and WHEREAS, the existing proposal would require the following variances : 1 ) Waive the minimum lot size for subdivision in a wetland zoning district. • 2 ) Waive the minimum lot footage for subdividing within a wetland zoning district. 3 ) Waive the requirement that all structures shall be set back at least 100 feet from a designated wetland . WHEREAS, the existing proposal also needs a conditional use permit for filling within a flood plain and a wetland altera- tion permit to change the wetland boundaries, and WHEREAS, Staff , City Consultants and the Planning Commis- sion have extensively reviewed the proposed development; and WHEREAS , the Mounds View Municipal Code 40 . 26 , Subd . D, states the criteria for granting a variance; and WHEREAS , there are no extraordinary circumstances as presented which apply to the property which do not apply to other properties in a wetland zoning district; NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission denies Dynamic Designers' request for a variance from lot size and lot width requirements in a wetland .
