No. <br /> construction at the Sands Apartments. 223-88, <br /> Variance <br /> City Planner Herman reviewed her memo of April 29, Request for <br /> stating that she had been told by the architect that A&L Management, <br /> several revisions were being made to the original 5445 Jackson <br /> drawings, and that she had not received them yet so Drive (Sands <br /> could not comment on them specifically, but she did Apartments) , <br /> advise that the proposed changes would not significantly Planning Case <br /> alter the circumstances in the request for a variance. No. 239-88 <br /> Mr. Torma presented the new drawings to the Planning <br /> Commission and reviewed the proposed changes, for the <br /> construction of a new apartment for the resident <br /> manager. <br /> City Planner Herman stated she felt the same consi- <br /> derations would apply, and the parking requirements <br /> would not be met, as an additional living unit was <br /> being added, and they were short already. She <br /> recommended denial of the request based on that <br /> shortage, being specifically 43 garage units short <br /> and two outdoor parking spaces short. <br /> Chairman Mountin stated the garages were built accord- <br /> /ling to Code at the time, and there is no room now for <br /> them to come into compliance. She states she appre- <br /> ciates their attempt to upgrade the building and <br /> provide for their on-site manager, but if a variance <br /> were to be granted now, they would have to use the <br /> same measure for anyone else who was under the <br /> parking code requirements. <br /> Commissioner Saunders stated he was concerned with <br /> setting a precedence if a variance were granted. <br /> Commissioner Zollner stated she did not feel it <br /> could be approved, due to the lack of a hardship <br /> for granting a variance. <br /> Commissioner Miller stated the Planning Commission <br /> is charged with insuring that development fits with <br /> Code, and she could not approve this, as they have <br /> other options. <br /> Commissioner Simons stated he agreed, and he did <br /> not want to set an unfortunate precedence. <br /> Chairman Mountin stated that she also was having <br /> a problem with granting a variance, as the criteria <br /> •to grant a variance was not being met. <br /> Mr. Torma asked if it would be alright to make <br /> improvements to the building if it did not include <br /> any additional living space. <br />
