Mounds View Planning Commission October 5 , 1988 <br /> Regular Meeting Page Two <br /> Ohas blue prints and a real estate agreement just about <br /> ready to go , and had planned to have a sign on the <br /> property next week, but now the developer will not <br /> enter into an agreement if the property' s zoning is going <br /> to be changed. He stated that if it is down zoned, he <br /> will lose everything and will go back to Court against <br /> the City. <br /> Mr. Johnson added he has a certificate of the real <br /> estate value with both the present zoning and proposed <br /> rezoning , and the proposed rezoning goes totally against <br /> the Court order. <br /> City Planner Herman stated she had spoken with Attorney <br /> Meyers concerning rezoning , and it is an on-going process <br /> which the Planning Commission will be involved in for <br /> some time . She acknowledged that Mr. Johnson has the <br /> only R-0 property in Mounds View. <br /> Chairman Mountin explained the Planning Commission first <br /> discussed this at their last agenda session , and they have <br /> not formally written or presented anything to the Council . <br /> Mr. Johnson suggested the Planning Commission inform <br /> Attorney Meyers that he will be watching this very closely. <br /> •Chairman Mountin assured Mr . Johnson there would be further <br /> discussions before any action is taken. <br /> Mr. Johnson asked that he be informed when the discussions <br /> are going to take place , as both he and his lawyer would <br /> like to attend. <br /> It was noted there was no one present to represent the 5 . Consideration <br /> applicant. of Resolution <br /> No. 236-88 <br /> City Planner Herman advised she had spoken with the <br /> applicant , who wants to go ahead with the request for <br /> a conditional use permit. She added she had spoken <br /> with the City Attorney, and based on his recommenda- <br /> tions , added items 7-10 as conditions in the proposed <br /> resolution , and she reviewed those conditions. <br /> Chairman Mountin asked the status of the gas tanks in <br /> the ground on the property. <br /> Councilmember Wuori replied she believes one is still <br /> being used , and she is not sure what has been done to <br /> the others . <br /> • Chairman Mountin stated she is uncomfortable with <br /> not knowing the status of the tanks and the applicant <br /> not coming to any of their discussions to answer <br /> questions . She added she would like additional <br /> information on the gas tanks . <br />
