Consideration • proposed draft ordinance amending Chapter 40 relative of Draft Ordi- to accessory uses or equipment in side yards since nance Amending it was last discussed at the Planning Commission Chapter 40 of agenda session. the Municipal Code She advised that the Police Department and Building Inspector are concerned about the enforcement of the ordinance change which requires recreational vehicles to be parked 5 ' from a lot line. They expressed their concern over selective enforcement and that City residents are not used to this provision and it could pose problems in making them aware of the change and getting them to comply. There was discussion among the Commission concerning enforcement of Codes. Most enforcement is a direct result of complaints received by the City. The Police Department does not like to be involved in the enforce- ment of all ordinances, and they do not have the time, while patrolling the City, to enforce all violations . It was noted that while there are big lots in the community, people do not always place their structures in a workable manner and may have trouble meeting the 5 ' setback requirement . It was also noted that people placing their recreational vehicles and other equipment 41, right up to the property line can cause a disturbance or inconvenience for their neighbors. It was the concensus of the Commissioners that this needs to be acted on, and the public hearing stage at the Council level would be a good opportunity for residents to express their opinions. It will also need a good deal of publication and exposure to make people aware of the change once it occurs. Motion/Second: Alman/Burgers to adopt the Draft Ordinance amending the Municipal Code of Mounds View by amending Chapter 40 entitled, "Zoning, Section I , Chapter 40.04, Subdivision F(3 ) , and Section II , Chapter 40. 05, Subdivision E(4-6 ) , and forward it to the Council . 4 ayes 0 nays Motion Carried City Planner Herman reported grading work was begun 7. Staff Report on the SYSCO project . The EAW is up for approval before the Council on December 12. City Planner Herman reported Donn Wiski of Resolution, Inc. , made a presentation to the Council at their last 411 agenda session concerning the Comprehensive Plan Update. It will be redrafted and then the Planning Commission will be given the opportunity to take action on it and send it on to the Council .
