RESOLUTION NO. 265-89 <br /> PAGE TWO <br /> 111 <br /> WHEREAS, the Planning Commission has also reviewed <br /> the Conditional Use Permit for the convenience food <br /> restaurant with drive-through facilities and the proposed <br /> development site plans associated with the new structure; <br /> and <br /> WHEREAS, the Planning Commission has reviewed the <br /> parking and circulation for the entire Mounds View Square <br /> Center site and has determined that the site plan provides <br /> 503 parking spaces when 537 parking spaces are required for <br /> a shortage of 34 parking spaces; and <br /> WHEREAS the Planning Commission has determined that <br /> they approve of waiving of the installation of 34 additional <br /> parking stalls as permitted with a CUP/PUD district ; and <br /> WHEREAS, the Planning Commission has reviewed the <br /> traffic and parking study done by Benshoof and Associates; <br /> and <br /> WHEREAS, the Planning Commission has reviewed the <br /> City Engineer ' s memo regarding the traffic and parking <br /> study; and <br /> WHEREAS, the Planning Commission is in <br /> agreement with the City Engineer ' s and Benshoof ' s traffic <br /> and parking study; and <br /> WHEREAS, the Planning Commission has reviewed the <br /> City Forester ' s recommendations dated September 15th and <br /> agrees with the proposed recommendations ; and <br /> WHEREAS, the Planning Commission has reviewed the <br /> proposed sign request which is in conformance with the City <br /> sign code and determines that it is acceptable. <br /> NOW, THEREFORE, BE IT RESOLVED that the Planning <br /> Commission recommends to the City Council approval of the <br /> requested rezoning from B-4 to B-3, the conceptual <br /> Conditional Use Permit/Planned Unit Development and the <br /> Conditional Use Permit for the convenience food restaurant <br /> with drive-through facilities contingent upon: <br /> 1. The developer enter into and sign a development <br /> agreement with the City. <br /> 2. There shall not be excessive noise as a result <br /> of the drive through restaurant outdoor menu <br /> board. <br /> 3. All requirements of the City Forester dated <br /> September 15, 1989 are complied with. <br />
