Call to <br /> order by Chair Mountin at 8:48 PM on Wednesday, Order <br /> March 21, 1990, following an agenda session. . <br /> MEMBERS PRESENT: Commissioners Burgers, Colleen, 2. Roll Call <br /> Dian, Jones, Zollner and Chair Mountin. <br /> It was noted Commissioner Miller had an excused <br /> absence. <br /> ALSO PRESENT: Councilmember Wuori and City Planner <br /> Hren. <br /> There were no residents requests or comments from 3. Residents <br /> the floor. Requests <br /> • <br /> City Planner Hren reported the hardship statement 4. Consideration <br /> which had been presented by the applicant at the of Resolution <br /> March 7 meeting had been forwarded to the City No. 282-90 <br /> Attorney, and he addressed both the hardship state- Regarding <br /> ment and the question of grandfathering . The attorney Variance Re- <br /> has determined there is no hardship nor grandfathered quest and <br /> rights. Resolution No. <br /> 283-90 Regarding <br /> John Bakus, representing the applicant, pointed out Conditional Use <br /> they have totally changed their site plan, and have Permit Request <br /> done many other things they have never had to do in by Phillips 66 <br /> another city. He added they have had no problem Company, 2525 <br /> getting variances in other cit'_e , but also admitted Highway 10, <br /> they could not show a hardshi_, ;,n this particular Planning Case <br /> request . No. 288-90 <br /> Mr. Bakus requested item 7 under the conditional use <br /> permit be changed, so as to not require a blower <br /> system. He explained they have heat pads planned, <br /> and the car wash will be closed anytime the temperature <br /> drops below 10 . He stated they will be losing <br /> income with the denial of access, and he feels the <br /> blower requirement would punish them for something <br /> • they have not yet done. <br /> Chair Mountin explained the blower requirement is a <br /> standard imposed on all car washes constructed in <br /> the city. <br />
