Ms. Hren explained the drain would be required, but the heating pad wouldn ' t. Mr. Bakus stated he would not withdraw the request for a variance. Chair Mountin noted the Planning Commission finds no hardship in the request of the applicant, and that finding is supported by the letter from City Attorney Karney. The letter will be attached to the resolution as an exhibit. She also requested the resolution about to be acted on by the Planning Commission be forwarded to the City Council prior to approval of the minutes. Commissioner Jones noted the exit onto Bronson Drive rather than Long Lake Road provides greater safety. Motion/Second: Dian/Jones to adopt Resolution No. 282-90, denying the variance request by Phillips 66 for curb cut location setback, 2525 Highway 10, Planning Case 288-90, and waive the • reading . 6 ayes 0 nays Motion Carried Motion/Second: Zollner/Dian to table proposed Resolution No. 283-90, the conditional use permit request of Phillips 66, until the site plan is presented. 6 ayes 0 nays Motion Carried Chair Mountin noted the Planning Commission needs to look at the site plan and adopt a resolution approving the site plan, before granting the requested conditional use permit . It was agreed the revised site plan could be reviewed by the Planning Commission and acted on at its next meeting, on April 4. Clerk/Administrator Pauley noted the Council must set a public hearing, which would be held during the first regular meeting in April, on April 9. •
