• Mounds View Planning Commission September 2, 1998 <br /> Regular Meeting Page 5 <br /> White stated the structure did not have footings. <br /> Brooks asked if a gravel walkway would work. <br /> Mrs. White told the Commission a gravel walkway would make it harder to move <br /> snowblowers, etc., and the gravel would be sloped creating a dangerous situation. <br /> Brasaemle asked if there were utility easements on the affected property line. <br /> Mr. White stated there were no utility easements on the north property line. He added, if <br /> he was not granted the variance he would cut the walkway back to the two foot <br /> requirement. <br /> Stevenson stated his main concern was the hazard created by the open space in between <br /> the side of the walkway and the fence. He added if the variance request is denied, the City <br /> should require the walkway to be cut back and have some type of safety rail on the fence <br /> side of the walkway. <br /> • Peterson stated there are some conflicts in the City ordinance that need to be resolved, <br /> i.e., allowing a one-foot set back for driveways and a two-foot setback for sidewalks. He <br /> explained to the Whites that if the Planning Commission denies the request they could <br /> appeal the decision to the City Council for their consideration, so the issue would not be <br /> dead at this meeting. <br /> Brooks suggested tabling the issue for two weeks to give staff the time they need to draft <br /> a resolution for approval. <br /> Brasaemle suggested modifying the ordinance so the setbacks of driveways and sidewalks <br /> are the same. Doing this would eliminate the need for the variance that is being requested, <br /> he added. Brasaemle told the Commission the slope at the property line and safety <br /> considerations would be the hardships. <br /> MOTION/SECOND: Brooks/Miller to table Resolution 556-98, a Resolution Approving a <br /> Variance Request for a Sidewalk, 5249 Greenfield, Timothy White, until the September 16, 1998 <br /> Planning Commission meeting. The Commission directed staff to draft a resolution approving the <br /> variance with the hardships as discussed at this meeting. <br /> Ayes - 5 Nays - 1(Obert) <br /> Motion carried <br />
