MEMORANDUM <br /> TO: PLANNING COMMISSION <br /> FROM: PAUL HARRINGTON, CITY PLANNER\\ <br /> DATE: January 21, 1994 <br /> SUBJECT: MINOR SUBDIVISION\LOT COMBINATION <br /> 8175 SPRING LAKE ROAD, PLANNING CASE NO. 371-93 <br /> Doug Jagunich has made application for a Minor Subdivision\Lot <br /> Combination of his property at 8175 Spring Lake Road. The request, <br /> if approved, would allow for the subdivision of an existing 1. 2 <br /> acre parcel into two (2) lots. The attached Certificate of Survey <br /> provides a visual depiction of the request. The application as <br /> submitted meets most general requirements as outlined in Chapter 42 <br /> "Subdivision Regulations" of the Municipal Code, however, the <br /> following minor issues will need to be addressed: <br /> 1) Chapter 42 . 09 Subdivision 2 (1) a; requires that in all new <br /> subdivisions, provision be made for the continuation of <br /> streets from adjoining areas and subdivisions. . The City has <br /> made a practice of acquiring right-of-way from property at <br /> the time of subdivision. In keeping with Municipal Code <br /> policy and past City practice, Staff would recommend that the <br /> Eastern most 30 feet of proposed Parcel 2 be dedicated to the <br /> public for use as right-of-way. <br /> 2) Chapter 42 . 09 Subdivision 4 (1) ; requires that easements at <br /> least ten (10) feet wide, centered on rear and other lot <br /> lines, shall be provided for utilities where necessary. <br /> Again, the City has, in the past, used the opportunity <br /> presented by subdivision requests to acquire the necessary <br /> utility easements. Staff will be providing a recommendation <br /> on utility easements Wednesday night following consultation <br /> with the Public Works Supervisor. <br /> 3) Chapter 42 . 09 Subdivision 6 (1) ; requires that all lots <br /> abut on a publicly dedicated street that has received legal <br /> status as such. Proposed Parcel 2 does not meet this <br /> requirement, however, the applicant has indicated to Staff <br /> verbally that he will be combining this Parcel with the Lot <br /> immediately North of the subdivision. Because the Lot to the <br /> • North abuts Spring Lake Road, the combining of the lots will <br /> allow the applicant to meet the intent of the Code. Staff <br /> would recommend that the combining of Parcel 2 with the Lot <br />
