In all instances the applicant has the <br /> burden of proof regarding the relative intensities of uses. <br /> However, such approval shall not serve to extend the <br /> amortization schedule established for the original use of the <br /> structure; <br /> f) If a non-conforming land use is superseded or replaced by a <br /> permitted use, the non-conforming status of the premises and <br /> any rights which arise under the provisions of this section <br /> shall terminate; and <br /> g) Notwithstanding the foregoing paragraphs of this subdivision, <br /> all non-conforming land uses which were made non-conforming by <br /> the zoning ordinance which became effective February 12 , 1966 <br /> shall be discontinued in accordance with the following <br /> schedule: <br /> 1) by March 1, 2016 for buildings of Type I and Type II fire <br /> resistive construction as defined in the Minnesota state <br /> building code; <br /> 2) by March 1, 2006 for buildings of Type II 1-hour, Type II <br /> 1111P non-rated, Type III and Type IV construction as defined <br /> in the Minnesota state building code; or <br /> 3) by March 1, 1996 for buildings of Type V construction as <br /> defined in the Minnesota state building code and for any <br /> other non-conforming land use not covered by <br /> subparagraphs 1) and 2) above. <br /> h) Notwithstanding the foregoing paragraphs of this subdivision, <br /> all non-conforming land uses which are made non-conforming by <br /> this ordinance shall be - discontinued in accordance with- the <br /> following srhg,dule: <br /> 1) by March 1, 2036 for buildings of Type I and Type II fire <br /> resistive construction as defined in the Minnesota state <br /> • building code; <br /> 2) by March 1, 2026 for buildings of Type II 1-hour, Type II <br /> non-rated, Type III and Type IV construction as defined <br /> in the Minnesota state building code; or <br /> 3) by March 1, 2016 for buildings of Type V construction as <br /> defined in the Minnesota state building code and for any <br /> other non-conforming land use not covered by <br /> subparagraphs 1) and 2) above. <br />
