• <br /> ZONING ORDINANCE <br /> SECTION 300 . 29 <br /> PAGE 235 4111 <br /> SUBDIVISION 4 . NON-CONFORMING LOTS OF RECORD. Non-conforming <br /> single family lots of record shall be subject to the provisions of <br /> section 300. 10, subdivision 7 of this ordinance. Any lot which was <br /> legally created but which became non-conforming due to changes in <br /> area or dimensional requirements and has been combined for tax <br /> purposes with a contiguous parcel or parcels may be divided only <br /> after approval by the city council even if the division is <br /> congruent with the original lot configuration. No variance shall <br /> be required to reconstruct a single family dwelling located on a <br /> non-conforming lot of record which is destroyed by natural disaster <br /> so long as the replacement dwelling has a footprint which is no <br /> larger than that of the destroyed structure and is substantially <br /> the same size in building height and floor area as the destroyed <br /> structure. Reconstruction shall commence within two years of the <br /> date of the destruction of the original building and reasonable <br /> progress shall be made in completing the project. A building <br /> permit shall be obtained prior to construction of the new dwelling <br /> and the new structure shall be constructed in compliance with all <br /> other city codes and regulations. <br /> SUBDIVISION 5. NON-CONFORMING SIGN. A non-conforming sign which <br /> does not -pose an imminent danger to life or property may remain and <br /> • be maintained by ordinary repairs provided the sign conforms to the111111 <br /> following: <br /> a) • shall not be altered or enlarged in any way; <br /> b) shall not be replaced by another non-conforming sign, except <br /> that changing the message on a sign shall not be deemed to be <br /> a replacement; <br /> c) shall not be relocated unless it is made to conform-to this <br /> ordinance; _ <br /> d) shall not be reconstructed after incurring damage in an amount <br /> exceeding 50 percent of its market value at the time of loss, <br /> as determined by the city; <br /> e) shall not be maintained through replacement of structural . <br /> elements; and <br /> f) shall not be required to be removed under any other section of <br /> the code of city ordinances. <br /> • <br /> A non-conforming sign which is an imminent danger to life or <br /> property or which incurs damage in an amount exceeding 50 percent <br /> of its market value at the time of loss shall be removed <br /> immediately at the expense of the owner. <br />
