• <br /> CHAPTER VI - C..^NCLUSICN • <br /> The purpose of this report has been to look at the general issue of adult <br /> entertainment uses and to provide information which might be used to assist in <br /> the determination of whether these businesses need to be the subject of more <br /> intense regulation in the City of Rochester. Because of the diversity of <br /> these uses and the wide array of potential regulatory approaches, much of the <br /> material assembled by• the staff could not be included in the report. If you <br /> would like to review in greater depth any item addressed in the report or have. <br /> questions regarding materials not included, please consult with the staff. <br /> The diversity of potential regulatory techniques reviewed above suggests that <br /> no one regulatory technique employed 'by another city will necessarily be a <br /> panacea for actual or potential problems in this community which are <br /> associated with adult entertainments. Cnce you have conscientiously examined <br /> the secondary effects of these establishments, you may very well conclude that <br /> a composite approach utilizing several of the proven techniques is most <br /> ' appropriate for our community. In any event it is important to keep in mind • <br /> the constitutional constraints and objectives which ultimately will determine_ <br /> whether you have properly balanced the rights of the operators of these <br /> establishments against the interests of this community in blight-free and safe <br /> neighborhoods. <br /> Based upon our research the staff offers the following conclusions for your • <br /> consideration: <br /> a) A considerable number of communities throughout the nation have <br /> studied the impacts which adult entertairimnts have on the areas • .. <br /> surrounding then. <br /> b) These studies have concluded that adult entertainment uses have an <br /> adverse impact on the surrounding neighborhoods. <br /> c) Residential neighborhoods in proximity to adult uses suffer adverse <br /> effects including increased crime rates, lowered property values, and <br /> increased transiency. <br /> • <br /> d) Values of both commercial and residential properties are diminished <br /> when located in proximity to adult entertainment businesses. <br /> e) The adverse impact on ccmmercial areas is increased by the presence of <br /> more than one adult entertainment use in close proximity to another <br /> adult enterzai n ent use. • <br /> f) The impact which an adult entertainment use has on the surrounding <br /> area appears to lessen as the distance frim the adult entertainment <br /> use increases. <br /> g) Reasonable "time, place and manner" restrictions which address the <br /> "secondary" :Impacts of adult entertainment uses are constitutionally • <br /> permissible. <br /> h) Any proposed regulation must be essentially. "content neutral". The <br /> First Amendment prohibits regulations at_ons which. attempt to regulate <br />
