MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 470-96 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING AMENDING THE MOUNDS VIEW MUNICIPAL CODE BY AMENDING CHAPTER 1006.06, SUBDIVISION 4, RELATING TO DEVELOPMENT CONTRACTS WHEREAS, Chapter 1006, entitled"Building Permits and Fees; Development Controls," currently requires development contracts to set forth all of the terms, conditions, requirements, agreements, guarantees and plans for the orderly development of land between the developer and the Municipality prior to the final approval of any subdivision, rezoning, special use permits, license or any building permits required for the construction, alteration or any building permits required for the construction, alteration, expansion to improvement of land; and WHEREAS, Staff and the Mounds View Planning Commission have reviewed this requirement and found it is necessary to assure that public and private site improvements are completed in compliance with development requirements, but may allow the requirements to be waived when no such improvements are involved; and WHEREAS, the Planning Commission recommends modification to Section 1006.06, Subdivision 4, to better clarify that such contracts are required when public and private site improvements are to be built, but to allow for a waiver when no such improvements are involved. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends approval of Ordinance No. 588, an ordinance relating to development contracts by amending Chapter 1006.06, Subdivision 4 of the Mounds View Municipal Code. BE IT FURTHER RESOLVED that the Mounds View Planning Commission directs Staff to forward this Resolution to the City Council prior to approval of the minutes.
