Siercks CUP Request <br />March 28, 2005 <br />Page 2 <br /> <br />As can be seen from the table on the previous page, the request for a conditional use permit <br />to construct the 1,032 square foot garage satisfies the zoning requirements. <br />The applicants are planning to construct an addition to the back of the existing detached <br />garage. The proposed garage addition would be setback five (5) feet from the side (south) <br />property line and twelve (12) feet from the rear (west) property line. Section 1104.01 <br />requires a five (5) foot setback, which the proposed garage satisfies. <br />In addition to the proposed garage, there is an existing 8 X 10 shed on the property. The <br />proposed garage and the existing shed would have a combined area of 1,112 square feet, <br />which would make up 19.8% of the rear yard area. This satisfies the Code, as the Code <br />allows the combined square footage of accessory structures to be up to 20% of the rear yard <br />area. <br /> <br />The Comprehensive Plan designates this property, 5343 Clifton Drive, as low-density <br />residential. <br /> <br /> <br />CUP Considerations: <br /> <br />Subdivision 3b of Section 1125.01 of the Mounds View Zoning Code indicates that the City <br />Council is to consider a general set of criteria when reviewing conditional use permits in <br />addition to any specific conditions enumerated. These general conditions are listed as <br />follows: <br /> <br />(1) The use will not create an excessive burden on existing parks, schools, streets and other <br />public facilities and utilities which serve or are proposed to serve the area. <br /> <br />The expanded garage will not create an excessive burden. No change in the land use is being <br />proposed. <br /> <br />(2) The use will be sufficiently compatible or separated by distance or screening from adjacent <br />residentially zoned or used land so that existing homes will not be depreciated in value and <br />there will be no deterrence to development of vacant land. <br /> <br />The expanded garage will allow for additional interior storage of vehicles and possessions <br />which are presently stored outside. The expanded garage will provide screening to the <br />applicants’ possessions and their activities, which include maintenance of racecars they own. <br /> <br />(3) The structure and site shall have an appearance that will not have an adverse effect upon <br />adjacent residential properties. <br /> <br />The garage will be expanded to 1,032 square feet, well below the maximum area of an <br />accessory building. The expansion will be finished to have a uniform and consistent <br />appearance with the existing garage, from the siding to the roof-line. <br /> <br /> <br />
