<br />There is a cost associated with the program. The MPCA charges $150.00 per hour for the <br />staff time spent on each project. Bob Lindall, from Kennedy and Graven, spoke with Patrice <br />Jensen, MPCA staff member, who stated that the range of hours incurred by the MPCA for a <br />review is 11.5 hours to 114 hours, with an average of 50 hours spent on a review. If the City <br />were to apply to the VIC program and the review took 50 hours of MPCA Staff time, the cost <br />to the City would be $7,500.00. MPCA has said that the same staff that worked on <br />Medtronic’s submittal would work on the City’s submittal and being that the same <br />environmental studies would be used, it should help to reduce the number of hours spent on <br />the review. <br /> <br />Should the Council decide to make application to the VIC program, the City would be <br />responsible for the cost incurred and follow-up on any MPCA requirements. Based on <br />comments from MPCA staff, it appears that MPCA will not make the City remove the debris, <br />although there is no guarantee. One MPCA staff member did comment that they might <br />require that the City place a restriction on the deed for the former Sysco property relating to <br />the debris that was found. If required, the deed restriction would not preclude development, <br />but may put in place conditions for any future development. <br /> <br />Recommendation: <br /> <br />A No Association letter would provide closure to the City and would make known the <br />enforcement intentions of the MPCA. Should the City choose not to proceed with the VIC <br />program, any future enforcement would be unknown.
