RLK Letter
May 19, 2005
Page 3

Right-of-Way
Comment:
Mn/DOT is working on the property rights, transfer, appraisal, and other items. If you
have any questions about these, please contact Keith McMurray, Mn/DOT Metro District
Right of Way Office, at 651-582-1635.

Response:
Comment noted.

Design
Comment:
It should also be noted that there is a high likelihood of a future need for major expansions
of TH 10 and Interstate Highway 35W in this vicinity. Developments such as The Bridges
will only increase the need for expansion. In view of that likelihood, the proposed location
of buildings within the development immediately adjacent to the TH 10 north right of way
line would preclude or severely hamper future expansion of the TH 10/I-35W system
interchange. To provide maximum flexibility for a future footprint for an expanded TH 10/I-
35W system interchange, we encourage the developer to consider placing any buildings
much further north in the development. Land uses in the portion of the development
adjacent to the TH 10-I-35W system interchange that will be more compatible with the need
for future highway expansion in this area include green space, surface parking, or ponding.
For more information on these points, please contact Richard Scarrow, Mn/DOT Metro
District Design, at 651-582-1333.

Response:
Comment noted. Please see highlights of the original response to this comment from
the first comment period reiterated below:

“The request to consider building placement further to the north is noted. The site plans
included in the AUAR are schematic in nature, and were prepared in order to identify the
massing and relative size of the “built” environment and associated potential environmental
impacts. The final site development plans will ultimately be the responsibility of the
developer. The site plan development will be in accordance with the current highway
setback requirements for buildings…The City of Mounds View will review the site plan with
consideration for the future improvements and expansion of TH 10.”

Permits
Comment:
Any use of or work within or affecting Mn/DOT right of way requires a permit. Permit forms
are available from Mn/DOT’s utility website at www.dot.state.mn.us/tecsup/utility. Please
direct any questions regarding permit requirements to Keith Van Wagner (651-582-1443),
or Buck Craig (651-582-1447) of Mn/DOT’s Metro Permits Section.

Response:
Comment noted.
