Mounds View Planning Commission <br /> II Page 3 <br /> August 16, 1996 <br /> Mr. Moon has requested that the ordinance be amended to make the setback between parking lots <br /> and property lines at least 15 feet, for churches adjacent to residential uses. The Planning <br /> Commission may recommend to City Council that the separation and level of screening between <br /> the church use and the adjacent residential properties, as it is proposed, is not sufficient to meet <br /> these criteria. One possible solution is to require that a wider"yard" or setback be created <br /> between the parking lot and the property line, or that more landscaping or a screening fence is <br /> needed. <br /> Conditional uses are distinguished from permitted uses for a reason. These uses are subject to <br /> greater scrutiny because they have the potential for creating greater impacts than the permitted <br /> uses in a given district. The purpose stated for a conditional use permit is"to provide the City <br /> with a reasonable degree of discretion in determining the suitability of certain designated uses <br /> upon the general welfare, public health and safety." The criteria for granting conditional permits <br /> are intended to assess, in part, the suitability and compatibility of such uses with adjacent <br /> permitted uses. <br /> Staff recognizes that the applicant has worked to design this project in accordance with the <br /> dimensions and numerical requirements specified in the Zoning Code, and has made improvements <br /> 41) in the site plan which have addressed the width of the access points, drainage, and preservation of <br /> some of the mature trees on the site. The application has been under review by the City since July <br /> 15, 1996. Testimony received from adjacent property owners indicate that questions remain <br /> about the compatibility of this project with the adjacent residential uses, in particular, the width of <br /> the required setback between the property line and the parking lot. Addressing compatibility is <br /> fundamental to the conditional use permit process. <br /> Actions Available: <br /> ■ Call to order to adopt a resolution recommending to City Council that a moratorium be <br /> imposed on the development of nonresidential uses subject to a conditional use permit in <br /> resrdent l zone districts, other than governmental and public utility buildings and <br /> structures necessary for the health, safety and general welfare of the community, model <br /> homes and accessory buildings and structures, in order to consider an ordinance <br /> amendment regarding parking lot setbacks between such uses and residential uses. <br /> • Discuss whether the site plan, as proposed, meets the criteria for approval of a conditional <br /> use permit, and advise the applicant as to the Planning Commission's concerns, to be <br /> addressed prior to the next regular meeting. <br /> cc: Dan Moon, 6929 Pleasant View Drive, Mounds View MN 55112 <br /> Bill Diem, Stahl Construction Company, 5900 Rowland Road, Minnetonka MN 55343; <br /> FAX 931-9941 <br /> • <br />
