(This resolution has not been reviewed by the City Attorney but we will <br /> forward it to him for review between now and your meeting on August 21.) <br /> Alternatives to This Action <br /> As an alternative to a moratorium, the Planning Commission may wish to address Mr. Moon's <br /> concern through the following: <br /> • The requirements listed for churches as conditional uses in the R-1 district (1106.04 Subd. <br /> 1.c. and d.): <br /> adequate screening from abutting residential uses and landscaping is provided in <br /> compliance with Section 1103.08 of this Title <br /> - adequate off-street parking and access is provided...and that such parking is <br /> adequately screened and landscaped from surrounding and abutting residential uses <br /> in compliance with Section 1103.08 of this Title <br /> A copy of 1103.08 and 1106.04 is attached. Based upon Section 1103.08 Subd. 6, staff <br /> concludes that Planning Commission has the ability to require either a screening fence or a <br /> green belt planting strip. The greenbelt planting strip shall consist of evergreens of • <br /> sufficient width and density to provide an effective screen, and shall be at least eight feet in <br /> height. A required screening fence shall be not more than eight feet but not less than six <br /> feet in height. <br /> The Planning Commission may want to consult with neighboring property owners on <br /> whether a greenbelt planting strip or screening fence is preferred to buffer the church from <br /> the adjacent residential properties. <br /> • The criteria for approving conditional use permits and the types of conditions which may <br /> be imposed, as stated in Sections 1125.01 Subd. 3.b.(1)-(8) and 1125.01 Subd.3.c. These <br /> sections have been attached to the memo regarding item #8 on this agenda. Staff would <br /> note, in particular, b.(2) and (3) and c.(1), which state: <br /> Criteria for Granting Conditional Use Permits <br /> (2) The use will be sufficiently compatible or separated by distance or screening from <br /> adjacent residentially zoned or used land so that existing homes will not be <br /> depreciated in value and there will be no deterrence to development of vacant land. <br /> (3) The structure and site shall have an appearance that will not have an adverse effect <br /> upon adjacent residential properties. <br /> These conditions may include, but are not limited to, the following: <br /> (1) Increasing the required lot size or yard dimension • <br />
