Planning Case No. 452-96 <br /> New Apostolic Church; 3025 County Road H <br /> September 4, 1996 <br /> Page 13 <br /> (5) The use is consistent with the purposes of the Zoning Code and the purposes of the zoning <br /> district in which the applicant intends to locate the purposed use. <br /> According to the Zoning Code, "the purpose of the R-1, single family district is to provide <br /> for low density single-family detached residential dwelling units and directly related, <br /> complementary uses." Churches are allowed in all residential districts in Mounds View, <br /> and one could conclude from this allowance that they are regarded as complementary <br /> uses. They require, however, approval of a conditional use permit. The conditional use <br /> permit process requires that a public hearing be held by the City Council before making its <br /> decision, and that property owners within 350 of the site be notified. Churches, therefore, <br /> are regarded as complementary uses which require special, discretionary review. The R-1 <br /> district is intended for low density, i.e. low intensity uses. The difficulty presented by the <br /> applicant's proposal is the size of the structure and the parking lot, in contrast to the <br /> typical pattern of development on residential lots in this neighborhood. Although the <br /> property at 3025 County Road H is larger than the minimum required, it is smaller than <br /> many of the adjacent lots along Pleasant View, Woodale, Woodcrest and Knollwood <br /> ,Drives. It is more intense, and there is insufficient room on the property to meet the <br /> • parking requirements and provide the type of buffer between the parking lot and the <br /> adjacent residences which is typical of other churches in Mounds View. The proposed <br /> church development, with a building of 2054 square feet and a 31-space parking lot, does <br /> not fit with the surrounding single family residential neighborhood. <br /> The Planning Commission may recommend that the City Council impose additional <br /> conditions considered necessary to protect the best interest of the surrounding area or the <br /> community as a whole. These conditions may include, but are not limited to, the <br /> following: <br /> (1) Increasing the required lot size or yard dimension. <br /> (2) Limiting the height,size or location of buildings. <br /> (3) Controlling the location and number of vehicle access points. <br /> (4) Increasing the street width. <br /> (5) Increasing the number of required off-street parking spaces. <br /> (6) Limiting the number,size,location or lighting of signs. <br /> (7) Requiring diking,fencing,screening,landscaping or other facilities to protect adjacent and <br /> nearby property. <br /> (8) Designating sites for open space. <br /> Staff Recommendation: Deny the conditional use permit application as presented. A <br /> resolution recommending denial has been prepared and is included with this report. <br /> • <br />
