• Planning Case No. 452-96 <br /> New Apostolic Church; 3025 County Road H <br /> September 18, 1996 <br /> Page 3 <br /> The reason that the application no longer needs a variance is that the "front" of the site has <br /> been changed from County Road H to Pleasant View Drive. The Zoning Code defines the <br /> front lot line as"that boundary of a lot which abuts a street, and in the case of a corner lot, <br /> it shall be the shortest dimension on a public street; should the dimensions be equal, the <br /> owner shall designate the front for the record." (In practice, when a property is already <br /> developed, the City often uses where a residence or business faces, or where the driveway <br /> enters the property on a corner lot to help in determining which side is considered the <br /> front. The Zoning Code indicates that the shortest dimension should be used.) <br /> • <br /> In this case, the shortest dimension is on Pleasant View Drive and the applicant is <br /> proposing to use this side as the front. They are showing the building at 35 feet from <br /> Pleasant View Drive, 30 feet from County Road H, 40 feet from the north property line <br /> (side) and 121.5 feet from the east property line (rear). These dimensions meet the <br /> requirements for setbacks in Section 1104.01(3) and Section 1106.04(1) a. and b. <br /> The conditional use permit and the development review are addressed in the analysis <br /> section of this report. Staff's review of the revised plan indicates that no variances are <br /> • required from the City's Zoning Code requirements. <br /> Wetland Alteration Permit: <br /> The east half of this site is located in the 100-foot buffer area of the Wetland Zoning <br /> District (Chapter 1010 of the Municipal Code). This chapter requires a wetland alteration <br /> permit be issued for any development in the Wetland Zoning District. Development is <br /> defined as"construction, installation or alteration of any structure, the extraction, clearing <br /> or other alteration of land or terrestrial or aquatic vegetation or the course, current or <br /> cross-section of any water body or watercourse or the subdivision of land into parcels..." <br /> Staff has determined that the proposed parking lot for the New Apostolic Church would <br /> be in the wet a d buffer area and the proposed church building would be located outside <br /> of Wetland Zoning District. A wetland alteration permit is required if this project is to <br /> proceed. If the Planning Commission forwards a recommendation of approval on the <br /> conditional use permit and the development review, staff recommends that they be made <br /> contingent on obtaining approval for a wetland alteration permit and this permit must be <br /> obtained prior to the issuance of any building permit. <br /> It would be advisable for the applicant to apply and obtain this permit prior to any <br /> irrevocable commitment to this site. <br /> • <br />
