Mounds View City Council June 27, 2005 <br />Regular Meeting Page 6 <br /> <br /> 1 <br /> Ayes-4 Nays-1 (Marty) Motion carried. 2 <br /> 3 <br />H. First Reading of Ordinance Authorizing the Sale of Land Comprising the 4 <br />Bridges of Mounds View Golf Course to the Mounds View Economic 5 <br />Development Authority. 6 <br /> 7 <br />Economic Development Coordinator Backman explained that to allow for the sale of the land to 8 <br />Medtronic, the current owner, -the City of Mounds View-, would be required to convey the 9 <br />property to the Mounds View Economic Development Authority. He indicated that several of 10 <br />the documents necessary for the sale have been attached for their review including Ordinance 11 <br />760, the legal description form of the Quit Claim Deed. 12 <br /> 13 <br />Council Member Thomas stated that she has had several discussions with City Administrator 14 <br />Ulrich as to whether this should be on tonight’s agenda. She explained that the Council does not 15 <br />want it to appear that they are rushing into things with this proposal noting that everyone is aware 16 <br />of the timetables. She further explained that she gave considerable thought to possibly asking 17 <br />that this item be pulled from the agenda noting that at the last minute she decided that it would be 18 <br />counterproductive to drag it out any further. She noted that it allows steps to proceed in every 19 <br />direction to go ahead with this and at this point there is not a lot that would be forestalled or 20 <br />changed. She explained that she wanted to bring this up due to the concerns she had and the 21 <br />discussions she had with Staff and Residents. She stated that it seems to help everyone involved 22 <br />to go ahead with this resolution 23 <br /> 24 <br />Mayor Marty asked City Attorney Riggs what the advantages would be if the City transfers the 25 <br />property to the EDA. 26 <br /> 27 <br />City Attorney Riggs explained that this is by Statute, an automatic right of reverter should the 28 <br />development not commence. He further explained that if the land is not built on that it would 29 <br />automatically have to come back to the EDA. He noted that the EDA, in this city, does oversee 30 <br />the tax increment programs and because that is what this is, a development contract, it is directly 31 <br />involved with the EDA. He noted that the main thing is the right to revert. He stated that if 32 <br />Council feels they want the ordinance to transfer the land directly from the city to Medtronic he 33 <br />did not think it would be a problem with Medtronic. He stated that it could be done this way if 34 <br />that is how Council wants it done. 35 <br /> 36 <br />Mayor Marty stated that he does not believe that Medtronic would go through all of this only to 37 <br />walk away from it and asked if the transfer to the EDA was necessary. 38 <br /> 39 <br />Council Member Gunn stated that it is her understanding that this is the process the City has 40 <br />always used in all types of land sales. 41 <br /> 42 <br />City Attorney Riggs confirmed that this is the same process the city has used in the past for land 43 <br />sales. 44 <br /> 45
